91_HB3404 LRB9112303JMmb 1 AN ACT concerning elections. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Election Code is amended by changing 5 Section 3-2 as follows: 6 (10 ILCS 5/3-2) (from Ch. 46, par. 3-2) 7 Sec. 3-2. (a) A permanent abode is necessary to 8 constitute a residence within the meaning of Section 3-1. No 9 elector or spouse shall be deemed to have lost his or her 10 residence in any precinct or election district in this State 11 by reason of his or her absence on business of the United 12 States, or of this State. Nothing in this Section shall be 13 construed to prevent homeless individuals from registering to 14 vote under the provisions of this Act. 15 (b) A homeless individual must have a mailing address in 16 order to be eligible to register to vote. For purposes of 17 this Act, a mailing address isshall constitutea homeless 18 individual's residence for voting purposes. A mailing 19 address of a homeless individual may include, but is not 20 limited to, a shelter, a day shelter, or a private residence. 21 Election authorities may by reasonable rules limit the 22 place where voter registration of homeless individuals may be 23 taken and the class of deputy registrars who may take the 24 voter registration of homeless individuals. 25 (c) Nothing in this Act shall be construed to confer 26 upon homeless individuals any additional privileges or 27 benefits other than the right to register to vote and to be 28 qualified to vote in an election under Articles 4, 5, and 6 29 of this Code. 30 (Source: P.A. 87-1241.)
