91_HB3327 LRB9110953JSgc 1 AN ACT to amend the Illinois Insurance Code by changing 2 Section 154.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Insurance Code is amended by 6 changing Section 154.5 as follows: 7 (215 ILCS 5/154.5) (from Ch. 73, par. 766.5) 8 Sec. 154.5. Improper claims practices). 9 (a) It is an improper claims practice for any domestic, 10 foreign or alien company transacting business in this State 11 to commit any of the acts contained in Section 154.6 if: 12 (1)(a)it is committed knowingly in violation of 13 this Act or any rules promulgated hereunder; or 14 (2)(b)it has been committed with such frequency to 15 indicate a persistent tendency to engage in that type of 16 conduct. 17 (b) Any person or entity violating this Section commits 18 an unlawful practice within the meaning of this Act and is 19 liable in a civil action for damages resulting to the injured 20 party. The court shall assess as part of the damages 21 reasonable attorney's fees and costs as a part of the action. 22 (Source: P.A. 80-926.) 23 Section 99. Effective date. This Act takes effect upon 24 becoming law.
