91_HB3271eng HB3271 Engrossed LRB9110230ACtm 1 AN ACT to amend the Emergency Medical Services (EMS) 2 Systems Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Emergency Medical Services (EMS) Systems 6 Act is amended by changing Section 3.205 as follows: 7 (210 ILCS 50/3.205) 8 Sec. 3.205. State Trauma Advisory Council. 9 (a) There shall be established within the Department of 10 Public Health a State Trauma Advisory Council, which shall 11 serve as an advisory body to the Department on matters 12 related to trauma care and trauma centers. 13 (b) Membership of the Council shall include one 14 representative from each Regional Trauma Advisory Committee, 15 to be appointed by each Committee. The Governor shall 16 appoint the following additional members: 17 (1) An EMS Medical Director, 18 (2) A trauma center medical director, 19 (3) A trauma surgeon, 20 (4) A trauma nurse coordinator, 21 (5) A representative from a private vehicle service 22 provider, 23 (6) A representative from a public vehicle service 24 provider, 25 (7) A member of the State EMS Advisory Council, 26 and.27 (8) A neurosurgeon. 28 (c) Of the members first appointed, 5 members shall be 29 appointed for a term of one year, 5 members shall be 30 appointed for a term of 2 years, and the remaining members 31 shall be appointed for a term of 3 years. The terms of HB3271 Engrossed -2- LRB9110230ACtm 1 subsequent appointees shall be 3 years. All appointees shall 2 serve until their successors are appointed and qualified. 3 (d) The Council shall be provided a 90-day period in 4 which to review and comment upon all rules proposed by the 5 Department pursuant to this Act concerning trauma care, 6 except for emergency rules adopted pursuant to Section 5-45 7 of the Illinois Administrative Procedure Act. The 90-day 8 review and comment period may commence upon the Department's 9 submission of the proposed rules to the individual Council 10 members, if the Council is not meeting at the time the 11 proposed rules are ready for Council review. Any 12 non-emergency rules adopted prior to the Council's 90-day 13 review and comment period shall be null and void. If the 14 Council fails to advise the Department within its 90-day 15 review and comment period, the rule shall be considered acted 16 upon; 17 (e) Council members shall be reimbursed for reasonable 18 travel expenses incurred during the performance of their 19 duties under this Section. 20 (f) The Department shall provide administrative support 21 to the Council for the preparation of the agenda and minutes 22 for Council meetings and distribution of proposed rules to 23 Council members. 24 (g) The Council shall act pursuant to bylaws which it 25 adopts, which shall include the annual election of a Chair 26 and Vice-Chair. 27 (h) The Director or his designee shall be present at all 28 Council meetings. 29 (i) Nothing in this Section shall preclude the Council 30 from reviewing and commenting on proposed rules which fall 31 under the purview of the State EMS Advisory Council. 32 (Source: P.A. 89-177, eff. 7-19-95; 90-655, eff. 7-30-98.) 33 Section 99. Effective date. This Act takes effect upon HB3271 Engrossed -3- LRB9110230ACtm 1 becoming law.
