 1        AN  ACT  to  amend  the  Charitable Games Act by changing
 2    Section 8.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  Charitable  Games  Act  is  amended by
 6    changing Section 8 as follows:

 7        (230 ILCS 30/8) (from Ch. 120, par. 1128)
 8        Sec. 8.  The conducting of charitable games is subject to
 9    the following restrictions:
10             (1)  The entire net proceeds from  charitable  games
11        must be exclusively devoted to the lawful purposes of the
12        organization permitted to conduct that game.
13             (2)  No person except a bona fide member or employee
14        of  the sponsoring organization, or a volunteer recruited
15        by the sponsoring organization, may  participate  in  the
16        management   or   operation   of   the   game.  A  person
17        participates  in  the  management  or  operation   of   a
18        charitable game when he or she sells admission tickets at
19        the  event;  sells, redeems, or in any way assists in the
20        selling or redeeming of  chips,  scrip,  or  play  money;
21        participates in the conducting of any of the games played
22        during  the  event,  or  supervises, directs or instructs
23        anyone conducting a game; or at any time during the hours
24        of  the  charitable  games  event  counts,  handles,   or
25        supervises   anyone  counting  or  handling  any  of  the
26        proceeds or chips, scrip, or play money at the event.   A
27        person  who is present to ensure that the games are being
28        conducted in conformance with the  rules  established  by
29        the  licensed  organization  or is present to insure that
30        the equipment is working properly  is  considered  to  be
31        participating  in  the management or operation of a game.

 1        Setting up, cleaning  up,  selling  food  and  drink,  or
 2        providing  security  for persons or property at the event
 3        does not constitute participation in  the  management  or
 4        operation of the game.
 5             Only  bona  fide  members,  volunteers as defined in
 6        Section 2 of this Act, and employees  of  the  sponsoring
 7        organization   may   participate  in  the  management  or
 8        operation of the games.  A person who participates in the
 9        management or operation of the games and  who  is  not  a
10        bona  fide  member,  volunteer as defined in Section 2 of
11        this Act, or employee of the sponsoring organization,  or
12        who  receives  remuneration  or other compensation either
13        directly or indirectly from any source for  participating
14        in  the  management or operation of the games, or who has
15        participated in the management or operation of more  than
16        4 charitable games events in the calendar year, commits a
17        violation   of   this   Act.   In  addition,  a  licensed
18        organization that utilizes any person  described  in  the
19        preceding sentence commits a violation of this Act.
20             (3)  No  person  may  receive  any  remuneration  or
21        compensation  either  directly  or  indirectly  from  any
22        source  for  participating in the management or operation
23        of the game.
24             (4)  No single bet at any game may exceed $10.
25             (5)  A bank shall be established on the premises  to
26        convert currency into chips, scrip, or other form of play
27        money which shall then be used to play at games of chance
28        which  the  participant  chooses.  Chips,  scrip, or play
29        money must be monogrammed with the logo of  the  licensed
30        organization  or  of the supplier.  Each participant must
31        be issued a  receipt  indicating  the  amount  of  chips,
32        scrip, or play money purchased.
33             (6)  At  the  conclusion  of  the  event or when the
34        participant leaves, he may cash in his chips,  scrip,  or

 1        play money in exchange for currency not to exceed $250 or
 2        noncash  prizes.   Each  participant  shall  sign for any
 3        receipt  of  prizes.   The  licensee  shall  provide  the
 4        Department of  Revenue  with  a  listing  of  all  prizes
 5        awarded.
 6             (7)  Each  licensee  shall  be  permitted to conduct
 7        charitable games on not more than 4 days each year.
 8             (8)  Unless  the  provider  of  the  premises  is  a
 9        municipality, the provider of the premises may  not  rent
10        or  otherwise  provide the premises for the conducting of
11        more than 8 charitable games nights per year.
12             (9)  Charitable games may not be played between  the
13        hours of 2:00 a.m. and noon.
14             (10)  No  person  under the age of 18 years may play
15        or participate in the  conducting  of  charitable  games.
16        Any  person  under  the age of 18 years may be within the
17        area where charitable games are being  played  only  when
18        accompanied by his parent or guardian.
19             (11)  No one other than the  sponsoring organization
20        of  charitable  games must have a proprietary interest in
21        the game promoted.
22             (12)  Raffles or other forms of gambling  prohibited
23        by  law  shall  not  be  conducted  on the premises where
24        charitable games are being conducted.
25             (13)  Such games are  not  expressly  prohibited  by
26        county  ordinance  for  charitable games conducted in the
27        unincorporated areas of the county or municipal ordinance
28        for charitable games conducted in  the  municipality  and
29        the  ordinance  is  filed with the Department of Revenue.
30        The Department shall provide each county or  municipality
31        with  a  list  of  organizations licensed or subsequently
32        authorized by the Department to conduct charitable  games
33        in their jurisdiction.
34             (14)  The  sale  of  tangible  personal  property at

 1        charitable games is subject to all State and local  taxes
 2        and obligations.
 3             (15)  Each  licensee  may  offer or conduct only the
 4        games listed below, which must be conducted in accordance
 5        with rules posted by the organization.  The  organization
 6        sponsoring  charitable  games shall promulgate rules, and
 7        make printed copies available to  participants,  for  the
 8        following games:  (a) roulette; (b) blackjack; (c) poker;
 9        (d)  pull tabs; (e) craps; (f) bang; (g) beat the dealer;
10        (h) big six; (i) gin rummy; (j) five card stud poker; (k)
11        chuck-a-luck;  (l)  keno;  (m)  hold-em  poker;  and  (n)
12        merchandise wheel; and (o)  wagers  on  videotaped  horse
13        races, commonly known as a nite at the races.  A licensee
14        need  not  offer  or conduct every game permitted by law.
15        The conducting of games not listed above is prohibited by
16        this Act.
17             (16)  No slot machines or  coin-in-the-slot-operated
18        devices  that allow a participant to play games of chance
19        based upon cards or dice shall be permitted to be used at
20        the location and during the time at which the  charitable
21        games are being conducted.
22             (17)  No cards, dice, wheels, or other equipment may
23        be  modified  or  altered  so  as  to give the licensee a
24        greater advantage in  winning,  other  than  as  provided
25        under the normal rules of play of a particular game.
26             (18)  No  credit  shall  be  extended  to any of the
27        participants.
28             (19)  No person may participate in the management or
29        operation of games at more than 4 charitable games events
30        in any calendar year.
31             (20)  A supplier may have  only  one  representative
32        present  at the charitable games event, for the exclusive
33        purpose of ensuring that its equipment is not damaged.
34             (21)  No employee, owner, or officer of a consultant

 1        service hired  by  a  licensed  organization  to  perform
 2        services  at  the  event  including,  but not limited to,
 3        security for persons or property at the event or services
 4        before the event including, but not limited to,  training
 5        for  volunteers  or  advertising  may  participate in the
 6        management or operation of the games.
 7             (22)  Volunteers as defined in Section 2 of this Act
 8        and bona fide  members  and  employees  of  a  sponsoring
 9        organization    may    not    receive   remuneration   or
10        compensation, either  directly  or  indirectly  from  any
11        source,  for participating in the management or operation
12        of games.  They may  participate  in  the  management  or
13        operation  of  no  more  than  4 charitable games events,
14        either  of  the  sponsoring  organization  or  any  other
15        licensed organization, during a calendar year.
16        Nothing in this Section shall be construed to prohibit  a
17    licensee  that  conducts charitable games on its own premises
18    from also obtaining a providers' license in  accordance  with
19    Section 5.1.

22        Section 99.  Effective date.  This Act takes effect  upon
23    becoming law.
