1 AN ACT to amend the Illinois Underground Utility
2 Facilities Damage Prevention Act by adding Section 8.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Underground Utility Facilities
6 Damage Prevention Act is amended by adding Section 8.5 as
7 follows:
8 (220 ILCS 50/8.5 new)
9 Sec. 8.5. Emergency response agency; cost. A person
10 who, in the performance of activities regulated by this Act,
11 necessitates action by an emergency response agency, as
12 defined in Section 3 of Hazardous Material Emergency Response
13 Reimbursement Act, shall reimburse the emergency response
14 agency for the costs of its response action.
