1 AN ACT to amend the Non-Support Punishment Act by
2 changing Section 10.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Non-Support Punishment Act is amended by
6 changing Section 10 as follows:
7 (750 ILCS 16/10)
8 Sec. 10. Proceedings. A proceeding Proceedings under
9 this Act may be by indictment or information. No proceeding
10 may be brought under Section 15 against a person whose court
11 or administrative order for support was entered by default,
12 unless the indictment or information specifically alleges
13 that the person has knowledge of the existence of the order
14 for support and that the person has the ability to pay the
15 support.
