 1        AN ACT concerning county officers.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Counties  Code  is  amended  by  adding
 5    Section 2-4006.5 as follows:

 6        (55 ILCS 5/2-4006.5 new)
 7        Sec. 2-4006.5. Commissioners in certain counties.
 8        (a) If a county elects 3  commissioners  at  large  under
 9    Section  2-4006,  registered  voters of such county may, by a
10    vote of a majority  of  those  voting  on  such  proposition,
11    determine  to  increase  the  size  of  the  board  of county
12    commissioners to 5 members who shall be elected  from  single
13    member  districts.  In  order  for such question to be placed
14    upon the ballot, such petition must contain the signatures of
15    not fewer than 10% of the registered voters of such county.
16        The number of commissioners  may  not  be  increased  and
17    commissioners may not be elected from single member districts
18    until  the  question of  electing 5 commissioners from single
19    member districts has been submitted to the  electors  of  the
20    county  at  a  regular election and approved by a majority of
21    the electors voting on the question.  The commissioners  must
22    certify  the question to the proper election authority, which
23    must submit the question at an election  in  accordance  with
24    the Election Code.
25        The question must be in substantially the following form:
26             Shall  the board of county commissioners of (name of
27        county) consist of 5 commissioners  elected  from  single
28        member districts?
29    The votes must be recorded as "Yes" or "No".
30        If a majority of the electors voting on the question vote
31    in  the affirmative, a 5-member board of county commissioners

 1    shall  be  established  to  be  elected  from  single  member
 2    districts.
 3        (b) If the  voters  of  the  county  decide  to  elect  5
 4    commissioners  from  single  member  districts,  the  General
 5    Assembly  shall,  by  law, on or before August 31 of the year
 6    following the 2000 federal decennial census divide the county
 7    into 5 compact and  contiguous  county  commission  districts
 8    that are substantially equal in population.  On or before May
 9    31  of  the  year  following  each  federal  decennial census
10    thereafter,  the  board   of   county   commissioners   shall
11    reapportion  the  county  commission districts to be compact,
12    contiguous, and substantially equal in population.
13        (c) The commissioners elected at large at or  before  the
14    general  election  in  2000 shall continue to serve until the
15    expiration  of  their  terms.  Of  those  commissioners,  the
16    commissioner whose term expires in 2002 shall be assigned  to
17    district 1; the commissioner whose term expires in 2004 shall
18    be  assigned  to  district 2; and the commissioner whose term
19    expires in 2006 shall be assigned to district 3.
20        (d) At the general election  in  2002,  one  commissioner
21    from  each of districts 1, 4, and 5 shall be elected.  At the
22    general election in  2004,  one  commissioner  from  each  of
23    districts  1,  2,  and  5  shall  be elected.  At the general
24    election in 2006, one commissioner from each of districts  2,
25    3,  and 4 shall be elected.  At the general election in 2008,
26    one commissioner from each of districts 1, 3, and 5 shall  be
27    elected.   At  the general election in 2010, one commissioner
28    from each of districts 2 and 4  shall  be  elected.   At  the
29    general  election  in  2012, commissioners from each district
30    shall be elected.  Thereafter, commissioners shall be elected
31    at each general election to fill expired terms.
32        In the year following the decennial census  of  2010  and
33    every  10  years  thereafter,  the commissioners, publicly by
34    lot, shall divide the districts into 2 groups.  One group  of

 1    3  commissioners shall serve terms of 4 years, 4 years, and 2
 2    years and one group of 2 commissioners shall serve terms of 2
 3    years, 4 years, and 4 years.

 4        Section 99. Effective date. This Act  takes  effect  upon
 5    becoming law.
