91_HB2899eng HB2899 Engrossed LRB9108103SMpr 1 AN ACT concerning military memorials. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Department of Veterans Affairs Act is 5 amended by adding Section 2d as follows: 6 (20 ILCS 2805/2d new) 7 Sec. 2d. The National World War II Memorial Fund. There 8 is created in the State treasury the National World War II 9 Memorial Fund. The Department must make grants from the Fund 10 for the construction of a National World War II Memorial. 11 (20 ILCS 2805/2c rep.) 12 Section 10. The Department of Veterans Affairs Act is 13 amended by repealing Section 2c. 14 Section 15. The State Finance Act is amended by adding 15 Section 5.540 as follows: 16 (30 ILCS 105/5.540 new) 17 Sec. 5.540. The National World War II Memorial Fund. 18 (30 ILCS 105/5.422 rep.) 19 Section 20. The State Finance Act is amended by 20 repealing Section 5.422. 21 Section 25. The Illinois Income Tax Act is amended by 22 adding Section 507V and changing Sections 509 and 510 as 23 follows: 24 (35 ILCS 5/507V new) 25 Sec. 507V. National World War II Memorial Fund checkoff. HB2899 Engrossed -2- LRB9108103SMpr 1 The Department must print on its standard individual income 2 tax form a provision indicating that if the taxpayer wishes 3 to contribute to the National World War II Memorial Fund, as 4 authorized by this amendatory Act of the 91st General 5 Assembly, he or she may do so by stating the amount of the 6 contribution (not less than $1) on the return and that the 7 contribution will reduce the taxpayer's refund or increase 8 the amount of payment to accompany the return. Failure to 9 remit any amount of increased payment reduces the 10 contribution accordingly. This Section does not apply to any 11 amended return. 12 (35 ILCS 5/509) (from Ch. 120, par. 5-509) 13 Sec. 509. Tax checkoff explanations. All individual 14 income tax return forms shall contain appropriate 15 explanations and spaces to enable the taxpayers to designate 16 contributions to the Child Abuse Prevention Fund, to the 17 Community Health Center Care Fund, to the Illinois Wildlife 18 Preservation Fund as required by the Illinois Non-Game 19 Wildlife Protection Act, to the Alzheimer's Disease Research 20 Fund as required by the Alzheimer's Disease Research Act, to 21 the Assistance to the Homeless Fund as required by this Act, 22 to the Heritage Preservation Fund as required by the Heritage 23 Preservation Act, to the Child Care Expansion Program Fund as 24 required by the Child Care Expansion Program Act, to the Ryan 25 White AIDS Victims Assistance Fund, to the Assistive 26 Technology for Persons with Disabilities Fund, to the 27 Domestic Violence Shelter and Service Fund, to the United 28 States Olympians Assistance Fund, to the Youth Drug Abuse 29 Prevention Fund, to the Persian Gulf Conflict Veterans Fund, 30 to the Literacy Advancement Fund, to the Ryan White Pediatric 31 and Adult AIDS Fund, to the Illinois Special Olympics 32 Checkoff Fund, to the Penny Severns Breast and Cervical 33 Cancer Research Fund, to the Korean War Memorial Fund, to the HB2899 Engrossed -3- LRB9108103SMpr 1 Heart Disease Treatment and Prevention Fund, to the 2 Hemophilia Treatment Fund, to the Mental Health Research 3 Fund, to the Children's Cancer Fund, to the American Diabetes 4 Association Fund, to the National World War IIWomen in5Military ServiceMemorial Fund, to the Prostate Cancer 6 Research Fund, and to the Meals on Wheels Fund. Each form 7 shall contain a statement that the contributions will reduce 8 the taxpayer's refund or increase the amount of payment to 9 accompany the return. Failure to remit any amount of 10 increased payment shall reduce the contribution accordingly. 11 If, on October 1 of any year, the total contributions to 12 any one of the funds made under this Section do not equal 13 $100,000 or more, the explanations and spaces for designating 14 contributions to the fund shall be removed from the 15 individual income tax return forms for the following and all 16 subsequent years and all subsequent contributions to the fund 17 shall be refunded to the taxpayer. 18 (Source: P.A. 90-171, eff. 7-23-97; 91-104, eff. 7-13-99; 19 91-107, eff. 7-13-99; 91-357, eff. 7-29-99; revised 8-23-99.) 20 (35 ILCS 5/510) (from Ch. 120, par. 5-510) 21 Sec. 510. Determination of amounts contributed. The 22 Department shall determine the total amount contributed to 23 each of the following: the Child Abuse Prevention Fund, the 24 Illinois Wildlife Preservation Fund, the Community Health 25 Center Care Fund, the Assistance to the Homeless Fund, the 26 Alzheimer's Disease Research Fund, the Heritage Preservation 27 Fund, the Child Care Expansion Program Fund, the Ryan White 28 AIDS Victims Assistance Fund, the Assistive Technology for 29 Persons with Disabilities Fund, the Domestic Violence Shelter 30 and Service Fund, the United States Olympians Assistance 31 Fund, the Youth Drug Abuse Prevention Fund, the Persian Gulf 32 Conflict Veterans Fund, the Literacy Advancement Fund, the 33 Ryan White Pediatric and Adult AIDS Fund, the Illinois HB2899 Engrossed -4- LRB9108103SMpr 1 Special Olympics Checkoff Fund, the Penny Severns Breast and 2 Cervical Cancer Research Fund, the Korean War Memorial Fund, 3 the Heart Disease Treatment and Prevention Fund, the 4 Hemophilia Treatment Fund, the Mental Health Research Fund, 5 the Children's Cancer Fund, the American Diabetes 6 Association Fund, the National World War IIWomen in Military7ServiceMemorial Fund, the Prostate Cancer Research Fund, and 8 the Meals on Wheels Fund; and shall notify the State 9 Comptroller and the State Treasurer of the amounts to be 10 transferred from the General Revenue Fund to each fund, and 11 upon receipt of such notification the State Treasurer and 12 Comptroller shall transfer the amounts. 13 (Source: P.A. 90-171, eff. 7-23-97; 91-104, eff. 7-13-99; 14 91-107, eff. 7-13-99; revised 9-24-99.) 15 (35 ILCS 5/507Q rep.) 16 Section 30.
