91_HB2895 LRB9108855RCks 1 AN ACT to amend the Criminal Proceeding Interpreter Act 2 by changing Section 3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Proceeding Interpreter Act is 6 amended by changing Section 3 as follows: 7 (725 ILCS 140/3) (from Ch. 38, par. 165-13) 8 Sec. 3. Fees; payment. 9 (a) Except as otherwise provided in subsection (b), the 10 court shall determine a reasonable fee for all such 11 interpreter services which shall be paid out of the general 12 county funds. 13 (b) Upon entry of an order of conviction or disposition 14 of supervision in any criminal proceeding in which 15 interpreter services are provided, the court may enter 16 against the defendant, as additional costs and fees, the 17 reasonable costs of interpreter services. Upon appointment 18 of an interpreter by the court, the defendant must file an 19 affidavit with the court containing sufficient information to 20 ascertain the assets and liabilities of that defendant. If 21 the court determines the defendant to be indigent, the 22 defendant is not required to contribute to the interpreter 23 expense. This subsection (b) does not apply to interpreters 24 for the deaf or hearing impaired. 25 (Source: P.A. 77-1527.)
