91_HB2889 LRB9107952DHpk 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Sections 12-210 and 12-215. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Sections 12-210 and 12-215 as follows: 7 (625 ILCS 5/12-210) (from Ch. 95 1/2, par. 12-210) 8 Sec. 12-210. Use of head lamps and auxiliary driving 9 lamps. (a) Whenever the driver of any vehicle equipped 10 with an electric driving head lamp, driving head lamps, 11 auxiliary driving lamp or auxiliary driving lamps is within 12 500 feet of another vehicle approaching from the opposite 13 direction, the driver shall dim or drop such head lamp or 14 head lamps and shall extinguish all auxiliary driving lamps. 15 (b) The driver of any vehicle equipped with an electric 16 driving head lamp, head lamps, auxiliary driving lamp or 17 auxiliary driving lamps shall dim or drop such head lamp or 18 head lamps and shall extinguish all auxiliary driving lamps 19 when there is another vehicle traveling in the same direction 20 less than 300 feet to the front of him. 21 (c) No vehicle shall have the lighting system modified 22 to allow more than 2 electric head lamps to be lighted while 23 operating in the dimmed or dropped position. 24 (d) Nothing in this Section shall prohibit the use of 25 auxiliary driving lamps, commonly referred to as "fog" lamps, 26 when used in conjunction with head lamps, if such auxiliary 27 driving lamps are adjusted and so aimed that the glaring rays 28 are not projected into the eyes of drivers of oncoming 29 vehicles. 30 (e) Notwithstanding subsections (a) and (b) of this 31 Section, the lead vehicle of a funeral procession may operate -2- LRB9107952DHpk 1 driving head lamps that alternately flash high beams and low 2 beams while the funeral procession is in progress. 3 (Source: P.A. 85-1144.) 4 (625 ILCS 5/12-215) (from Ch. 95 1/2, par. 12-215) 5 Sec. 12-215. Oscillating, rotating or flashing lights on 6 motor vehicles. Except as otherwise provided in this Code: 7 (a) The use of red or white oscillating, rotating or 8 flashing lights, whether lighted or unlighted, is prohibited 9 except on: 10 1. Law enforcement vehicles of State, Federal or 11 local authorities; 12 2. A vehicle operated by a police officer or county 13 coroner and designated or authorized by local 14 authorities, in writing, as a law enforcement vehicle; 15 however, such designation or authorization must be 16 carried in the vehicle; 17 3. Vehicles of local fire departments and State or 18 federal firefighting vehicles; 19 4. Vehicles which are designed and used exclusively 20 as ambulances or rescue vehicles; furthermore, such 21 lights shall not be lighted except when responding to an 22 emergency call for and while actually conveying the sick 23 or injured; and 24 5. Tow trucks licensed in a state that requires 25 such lights; furthermore, such lights shall not be 26 lighted on any such tow truck while the tow truck is 27 operating in the State of Illinois. 28 (b) The use of amber oscillating, rotating or flashing 29 lights, whether lighted or unlighted, is prohibited except 30 on: 31 1. Second division vehicles designed and used for 32 towing or hoisting vehicles; furthermore, such lights 33 shall not be lighted except as required in this paragraph -3- LRB9107952DHpk 1 1; such lights shall be lighted when such vehicles are 2 actually being used at the scene of an accident or 3 disablement; if the towing vehicle is equipped with a 4 flat bed that supports all wheels of the vehicle being 5 transported, the lights shall not be lighted while the 6 vehicle is engaged in towing on a highway; if the towing 7 vehicle is not equipped with a flat bed that supports all 8 wheels of a vehicle being transported, the lights shall 9 be lighted while the towing vehicle is engaged in towing 10 on a highway during all times when the use of headlights 11 is required under Section 12-201 of this Code; 12 2. Motor vehicles or equipment of the State of 13 Illinois, local authorities and contractors; furthermore, 14 such lights shall not be lighted except while such 15 vehicles are engaged in maintenance or construction 16 operations within the limits of construction projects; 17 3. Vehicles or equipment used by engineering or 18 survey crews; furthermore, such lights shall not be 19 lighted except while such vehicles are actually engaged 20 in work on a highway; 21 4. Vehicles of public utilities, municipalities, or 22 other construction, maintenance or automotive service 23 vehicles except that such lights shall be lighted only as 24 a means for indicating the presence of a vehicular 25 traffic hazard requiring unusual care in approaching, 26 overtaking or passing while such vehicles are engaged in 27 maintenance, service or construction on a highway; 28 5. Oversized vehicle or load; however, such lights 29 shall only be lighted when moving under permit issued by 30 the Department under Section 15-301 of this Code; 31 6. The front and rear of motorized equipment owned 32 and operated by the State of Illinois or any political 33 subdivision thereof, which is designed and used for 34 removal of snow and ice from highways; -4- LRB9107952DHpk 1 7. Fleet safety vehicles registered in another 2 state, furthermore, such lights shall not be lighted 3 except as provided for in Section 12-212 of this Code; 4 8. Such other vehicles as may be authorized by 5 local authorities; 6 9. Law enforcement vehicles of State or local 7 authorities when used in combination with red 8 oscillating, rotating or flashing lights; 9 10. Vehicles used for collecting or delivering mail 10 for the United States Postal Service provided that such 11 lights shall not be lighted except when such vehicles are 12 actually being used for such purposes; 13 11. Any vehicle displaying a slow-moving vehicle 14 emblem as provided in Section 12-205.1; 15 12. All trucks equipped with self-compactors or 16 roll-off hoists and roll-on containers for garbage or 17 refuse hauling. Such lights shall not be lighted except 18 when such vehicles are actually being used for such 19 purposes; 20 13. Vehicles used by a security company, alarm 21 responder, or control agency, if the security company, 22 alarm responder, or control agency is bound by a contract 23 with a federal, State, or local government entity to use 24 the lights;and25 14. Security vehicles of the Department of Human 26 Services; however, the lights shall not be lighted except 27 when being used for security related purposes under the 28 direction of the superintendent of the facility where the 29 vehicle is located; and.30 15. The lead vehicle of a funeral procession as 31 authorized in Section 11-1420. 32 (c) The use of blue oscillating, rotating or flashing 33 lights, whether lighted or unlighted, is prohibited except 34 on: -5- LRB9107952DHpk 1 1. Rescue squad vehicles not owned by a fire 2 department and vehicles owned or fully operated by a: 3 voluntary firefighter; 4 paid firefighter; 5 part-paid firefighter; 6 call firefighter; 7 member of the board of trustees of a fire 8 protection district; 9 paid or unpaid member of a rescue squad; or 10 paid or unpaid member of a voluntary ambulance 11 unit. 12 However, such lights are not to be lighted except 13 when responding to a bona fide emergency. 14 2. Police department vehicles in cities having a 15 population of 500,000 or more inhabitants. 16 3. Law enforcement vehicles of State or local 17 authorities when used in combination with red 18 oscillating, rotating or flashing lights. 19 4. Vehicles of local fire departments and State or 20 federal firefighting vehicles when used in combination 21 with red oscillating, rotating or flashing lights. 22 5. Vehicles which are designed and used exclusively 23 as ambulances or rescue vehicles when used in combination 24 with red oscillating, rotating or flashing lights; 25 furthermore, such lights shall not be lighted except when 26 responding to an emergency call. 27 6. Vehicles that are equipped and used exclusively 28 as organ transport vehicles when used in combination with 29 red oscillating, rotating, or flashing lights; 30 furthermore, these lights shall only be lighted when the 31 transportation is declared an emergency by a member of 32 the transplant team or a representative of the organ 33 procurement organization. 34 (d) The use of a combination of amber and white -6- LRB9107952DHpk 1 oscillating, rotating or flashing lights, whether lighted or 2 unlighted, is prohibited, except motor vehicles or equipment 3 of the State of Illinois, local authorities and contractors 4 may be so equipped; furthermore, such lights shall not be 5 lighted except while such vehicles are engaged in highway 6 maintenance or construction operations within the limits of 7 highway construction projects. 8 (e) All oscillating, rotating or flashing lights 9 referred to in this Section shall be of sufficient intensity, 10 when illuminated, to be visible at 500 feet in normal 11 sunlight. 12 (f) Nothing in this Section shall prohibit a 13 manufacturer of oscillating, rotating or flashing lights or 14 his representative from temporarily mounting such lights on a 15 vehicle for demonstration purposes only. 16 (g) Any person violating the provisions of subsections 17 (a), (b), (c) or (d) of this Section who without lawful 18 authority stops or detains or attempts to stop or detain 19 another person shall be guilty of a Class 4 felony. 20 (h) Except as provided in subsection (g) above, any 21 person violating the provisions of subsections (a) or (c) of 22 this Section shall be guilty of a Class A misdemeanor. 23 (Source: P.A. 90-330, eff. 8-8-97; 90-347, eff. 1-1-98; 24 90-655, eff. 7-30-98; 91-357, eff. 7-29-99.)
