 1        AN ACT to amend the Illinois  Vehicle  Code  by  changing
 2    Sections 3-405.1 and 3-806.1.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The  Illinois  Vehicle  Code  is  amended  by
 6    changing Sections 3-405.1 and 4-806.1 as follows:

 7        (625 ILCS 5/3-405.1) (from Ch. 95 1/2, par. 3-405.1)
 8        Sec.  3-405.1.   Application  for vanity and personalized
 9    license plates.
10        (a)  Vanity  license  plates  mean  any  license  plates,
11    assigned to a passenger motor vehicle of the first  division,
12    to  a  motor vehicle of the second division registered at not
13    more than 8,000 pounds, or to a recreational vehicle, or to a
14    trailer that is designed and used for a purpose set forth  in
15    subsection  (g) of this Section, which display a registration
16    number containing 4 to 7 letters as requested by the owner of
17    the vehicle and license plates issued to retired  members  of
18    Congress  under  Section 3-610.1 or to retired members of the
19    General Assembly as provided in Section  3-606.1.  A  license
20    plate  consisting of 3 letters and no numbers or of 1, 2 or 3
21    numbers, upon its becoming available,  is  a  vanity  license
22    plate.  Personalized  license plates mean any license plates,
23    assigned to a passenger motor vehicle of the first  division,
24    to   a  motor  vehicle  of  the  second  division,  or  to  a
25    recreational vehicle, or to a trailer that  is  designed  and
26    used  for  a  purpose  set  forth  in  subsection (g) of this
27    Section, which display a  registration  number  containing  a
28    combination  of letters and numbers as prescribed by rule, as
29    requested by the owner of the vehicle.
30        (b)  For any registration period commencing  after  1979,
31    any  person  who is the registered owner of a passenger motor

 1    vehicle of the first division, of  a  motor  vehicle  of  the
 2    second  division registered at not more than 8,000 pounds, or
 3    of a recreational vehicle, or of a trailer that  is  designed
 4    and  used  for  a purpose set forth in subsection (g) of this
 5    Section registered with the Secretary of State or  who  makes
 6    application  for  an  original  registration  of such a motor
 7    vehicle or trailer or renewal registration of  such  a  motor
 8    vehicle  or  trailer may, upon payment of a fee prescribed in
 9    Section  3-806.1,  apply  to  the  Secretary  of  State   for
10    personalized license plates.
11        (c)  Except  for  plates  issued  under  Sections  3-627,
12    3-631,  and  3-632, vanity and personalized license plates as
13    issued under this Section shall be the same color and  design
14    as  other  passenger  vehicle  or  trailer license plates and
15    shall not in any manner  conflict  with  any  other  existing
16    passenger,   commercial,   trailer,  motorcycle,  or  special
17    license plate series.  However, special  registration  plates
18    issued  under  Sections 3-611 and 3-616 for vehicles operated
19    by or for persons with disabilities may  also  be  vanity  or
20    personalized license plates.
21        (d)  Vanity  and  personalized  license  plates  shall be
22    issued only to the registered owner of the vehicle  on  which
23    they  are  to  be  displayed,  except as provided in Sections
24    3-611 and 3-616 for special registration plates for  vehicles
25    operated by or for persons with disabilities.
26        (e)  An   applicant   for   the  issuance  of  vanity  or
27    personalized license plates  or  subsequent  renewal  thereof
28    shall file an application in such form and manner and by such
29    date  as  the  Secretary  of  State  may,  in his discretion,
30    require.
31        No  vanity  nor  personalized  license  plates  shall  be
32    approved,  manufactured,  or  distributed  that  contain  any
33    characters,   symbols   other    than    the    international
34    accessibility  symbol for vehicles operated by or for persons

 1    with disabilities, foreign words, or letters of punctuation.
 2        (f)  Vanity and personalized  license  plates  as  issued
 3    pursuant  to  this  Act  may  be  subject  to  the  Staggered
 4    Registration System as prescribed by the Secretary of State.
 5        (g)  The   Secretary   of   State  may  issue  vanity  or
 6    personalized license plates assigned to  a  trailer  if  that
 7    trailer  is  designed  and  used  for  one  of  the following
 8    purposes:
 9             (1)  the  transportation  of   a   boat   or   other
10        watercraft;
11             (2)  the transportation of a horse;
12             (3)  the transportation of a single motor vehicle.

16        Sec. 3-806.1.  Additional fees for vanity license plates.
17    In addition to the regular  registration  fee,  an  applicant
18    shall  be  charged  $75 for each set of vanity license plates
19    issued to a motor vehicle of the  first  division,  or  to  a
20    motor  vehicle  of the second division registered at not more
21    than 8,000 pounds, or to a  recreational  vehicle,  or  to  a
22    trailer  and  $40  for  each set of vanity plates issued to a
23    motorcycle.  In addition  to  the  regular  renewal  fee,  an
24    applicant shall be charged $10 for the renewal of each set of
25    vanity license plates.
