91_HB2881 LRB9107494NTsbB 1 AN ACT to amend the School Construction Law by changing 2 Sections 5-15 and 5-35. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Construction Law is amended by 6 changing Sections 5-15 and 5-35 as follows: 7 (105 ILCS 230/5-15) 8 Sec. 5-15. Grant entitlements. 9 (a) The State Board of Education is authorized to issue 10 grant entitlements for school construction projects and debt 11 service and shall determine the priority order for school 12 construction project grants to be made by the Capital 13 Development Board. When issuing a grant entitlement for a 14 school construction project, the Capital Development Board, 15 as a part of that entitlement, shall certify to the district 16 receiving the entitlement the dollar amount of the school 17 construction project's cost that the district will be 18 required to finance with non-grant funds in order to qualify 19 to receive a school construction project grant under this 20 Article from the Capital Development Board. 21 (b) In no event shall the amount of the actual school 22 construction project grant be less than the amount of the 23 initial grant entitlement issued in accordance with this 24 Section. This subsection (b) applies to all grant 25 entitlements for school construction projects issued by the 26 State Board of Education, including those issued before the 27 effective date of this amendatory Act of the 91st General 28 Assembly. 29 (Source: P.A. 90-548, eff. 1-1-98; 91-55, eff. 6-30-99.) 30 (105 ILCS 230/5-35) -2- LRB9107494NTsbB 1 Sec. 5-35. School construction project grant amounts; 2 permitted use; prohibited use. 3 (a) The product of the district's grant index, which may 4 not be less than the grant index used in the initial 5 determination of grant eligibility in the issuance of a grant 6 entitlement, and the recognized project cost, as determined 7 by the Capital Development Board, for an approved school 8 construction project shall equal the amount of the grant the 9 Capital Development Board shall provide to the eligible 10 district. The grant index shall not be used in cases where 11 the General Assembly and the Governor approve appropriations 12 designated for specifically identified school district 13 construction projects. 14 (b) In each fiscal year in which school construction 15 project grants are awarded, 20% of the total amount awarded 16 statewide shall be awarded to a school district with a 17 population exceeding 500,000, provided such district complies 18 with the provisions of this Article. 19 In addition to the uses otherwise authorized by this Law, 20 any school district with a population exceeding 500,000 is 21 authorized to use any or all of the school construction 22 project grants (i) to pay debt service, as defined in the 23 Local Government Debt Reform Act, on bonds, as defined in the 24 Local Government Debt Reform Act, issued to finance one or 25 more school construction projects and (ii) to the extent that 26 any such bond is a lease or other installment or financing 27 contract between the school district and a public building 28 commission that has issued bonds to finance one or more 29 qualifying school construction projects, to make lease 30 payments under the lease. 31 (c) No portion of a school construction project grant 32 awarded by the Capital Development Board shall be used by a 33 school district for any on-going operational costs. 34 (Source: P.A. 90-548, eff. 1-1-98; 91-38, eff. 6-15-99.) -3- LRB9107494NTsbB 1 Section 99.
