91_HB2880eng HB2880 Engrossed LRB9107218SMpr 1 AN ACT to amend the Cemetery Care Act by changing Section 2 2a. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Cemetery Care Act is amended by changing 6 Section 2a as follows: 7 (760 ILCS 100/2a) (from Ch. 21, par. 64.2a) 8 Sec. 2a. Powers and duties of cemetery authorities; 9 cemetery property maintained by cemetery care funds. With 10 respect to cemetery property maintained by cemetery care 11 funds, a cemetery authority shall be responsible for the 12 performance of: 13 (a) the care and maintenance of the cemetery property it 14 owns; and 15 (b) the opening and closing of all graves, crypts, or 16 niches for human remains in any cemetery property it owns. 17 A cemetery authority is authorized to access a cemetery 18 it owns to carry out its powers and duties under this Act, 19 including access through private property if no other access 20 is available. 21 (Source: P.A. 87-747.) 22 Section 99. Effective date. This Act takes effect upon 23 becoming law.
