 1        AN ACT to amend the Illinois Vehicle Code.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Illinois  Vehicle  Code  is  amended  by
 5    changing Sections 2-119 and 3-634 as follows:

 6        (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119)
 7        Sec. 2-119. Disposition of fees and taxes.
 8        (a)  All  moneys received from Salvage Certificates shall
 9    be deposited in the Common School Fund in the State Treasury.
10        (b)  Beginning January 1, 1990  and  concluding  December
11    31,  1994,  of  the  money  collected for each certificate of
12    title,  duplicate  certificate   of   title   and   corrected
13    certificate  of title, $0.50 shall be deposited into the Used
14    Tire  Management  Fund.   Beginning  January  1,   1990   and
15    concluding December 31, 1994, of the money collected for each
16    certificate  of  title,  duplicate  certificate  of title and
17    corrected certificate of title, $1.50 shall be  deposited  in
18    the  Park  and Conservation Fund.  Beginning January 1, 1995,
19    of  the  money  collected  for  each  certificate  of  title,
20    duplicate certificate of title and corrected  certificate  of
21    title,  $2  shall  be  deposited in the Park and Conservation
22    Fund.  The moneys deposited in the Park and Conservation Fund
23    pursuant to this Section shall be used  for  the  acquisition
24    and  development  of  bike  paths  as provided for in Section
25    63a36 of the Civil Administrative Code of Illinois. Except as
26    otherwise  provided  in  this  Code,  all  remaining   moneys
27    collected for certificates of title, and all moneys collected
28    for  filing  of  security  interests,  shall be placed in the
29    General Revenue Fund in the State Treasury.
30        (c)  All moneys collected for that portion of a  driver's
31    license  fee  designated  for  driver education under Section

 1    6-118 shall be placed in the Driver  Education  Fund  in  the
 2    State Treasury.
 3        (d)  Beginning  January  1, 1999, of the monies collected
 4    as a registration fee for each motorcycle, motor driven cycle
 5    and motorized pedalcycle, 27% of each annual registration fee
 6    for such vehicle and 27% of each semiannual registration  fee
 7    for  such  vehicle  is  deposited  in  the Cycle Rider Safety
 8    Training Fund.
 9        (e)  Of the monies received by the Secretary of State  as
10    registration fees or taxes or as payment of any other fee, as
11    provided  in  this Act, except fees received by the Secretary
12    under paragraph (7) of subsection (b) of  Section  5-101  and
13    Section  5-109  of this Code, 37% shall be deposited into the
14    State Construction Fund.
15        (f)  Of the total money collected for a  CDL  instruction
16    permit  or  original  or  renewal  issuance  of  a commercial
17    driver's license (CDL) pursuant  to  the  Uniform  Commercial
18    Driver's  License  Act  (UCDLA),  $6  of the total fee for an
19    original or renewal CDL, and $6 of the total CDL  instruction
20    permit fee when such permit is issued to any person holding a
21    valid  Illinois  driver's  license,  shall  be  paid into the
22    CDLIS/AAMVAnet  Trust  Fund  (Commercial   Driver's   License
23    Information  System/American  Association  of  Motor  Vehicle
24    Administrators  network Trust Fund) and shall be used for the
25    purposes provided in Section 6z-23 of the State Finance Act.
26        (g)  All remaining moneys received by  the  Secretary  of
27    State  as  registration  fees  or  taxes or as payment of any
28    other fee, as provided in this Act, except fees  received  by
29    the  Secretary  under  paragraph  (7)  of  subsection  (b) of
30    Section 5-101 and  Section  5-109  of  this  Code,  shall  be
31    deposited  in the Road Fund in the State Treasury.  Moneys in
32    the Road Fund shall be used  for  the  purposes  provided  in
33    Section 8.3 of the State Finance Act.

 3        (k)  There  is  created  in  the State Treasury a special
 4    fund to be known as the Secretary of  State  Special  License
 5    Plate  Fund.  Money deposited into the Fund shall, subject to
 6    appropriation, be used by the  Office  of  the  Secretary  of
 7    State  (i)  to  help  defray  plate  manufacturing  and plate
 8    processing costs  for  the  issuance  and,  when  applicable,
 9    renewal  of  any  new or existing special registration plates
10    authorized under this Code and (ii) for grants  made  by  the
11    Secretary   of   State  to  benefit  Illinois  Veterans  Home
12    libraries.
13        On or before October 1,  1995,  the  Secretary  of  State
14    shall  direct  the  State  Comptroller and State Treasurer to
15    transfer any unexpended balance in the Special  Environmental
16    License  Plate  Fund,  the Special Korean War Veteran License
17    Plate Fund, and the Retired Congressional License Plate  Fund
18    to the Secretary of State Special License Plate Fund.
19        (l)  The  Motor Vehicle Review Board Fund is created as a
20    special fund in the State Treasury.   Moneys  deposited  into
21    the  Fund  under  paragraph  (7) of subsection (b) of Section
22    5-101 and Section 5-109 shall, subject to  appropriation,  be
23    used  by  the  Office of the Secretary of State to administer
24    the Motor Vehicle Review Board, including without  limitation
25    payment  of  compensation and all necessary expenses incurred
26    in administering the Motor Vehicle  Review  Board  under  the
27    Motor Vehicle Franchise Act.
28        (m)  Effective  July  1,  1996,  there  is created in the
29    State Treasury a special fund  to  be  known  as  the  Family
30    Responsibility  Fund.   Moneys deposited into the Fund shall,
31    subject to appropriation,  be  used  by  the  Office  of  the
32    Secretary  of  State  for the purpose of enforcing the Family
33    Financial Responsibility Law.
34        (n)  The Illinois Fire Fighters' Memorial Fund is created

 1    as a special fund in the State  Treasury.   Moneys  deposited
 2    into the Fund shall, subject to appropriation, be used by the
 3    Office  of  the  State  Fire  Marshal for construction of the
 4    Illinois Fire Fighters' Memorial to be located at  the  State
 5    Capitol   grounds   in   Springfield,   Illinois.   Upon  the
 6    completion of the Memorial, moneys in the Fund shall be  used
 7    in accordance with Section 3-634 the Office of the State Fire
 8    Marshal   shall   certify   to   the   State  Treasurer  that
 9    construction of the Memorial has been completed.
10        (o)  Of the money collected for each certificate of title
11    for all-terrain vehicles  and  off-highway  motorcycles,  $17
12    shall be deposited into the Off-Highway Vehicle Trails Fund.

18        Sec. 3-634.  Illinois Fire Fighters' License Plate.
19        (a)  The  Secretary,  upon receipt of an application made
20    in the form prescribed by the Secretary of State,  may  issue
21    special  registration  plates  designated to be Illinois Fire
22    Fighters' Memorial license plates.  The special plates issued
23    under  this  Section  shall  be  affixed  only  to  passenger
24    vehicles of the first division, motor vehicles of the  second
25    division  weighing  not  more than 8,000 pounds, recreational
26    vehicles as defined in Section  1-169  of  this  Code,    and
27    subject  to the staggered registration system.  Plates issued
28    under this Section shall expire according to  the  multi-year
29    procedure established by Section 3-414.1 of this Code.
30        (b)  The  design  and color of the plates shall be wholly
31    within  the  discretion  of  the  Secretary  of  State.   The
32    Secretary  of  State may, in his or her discretion, allow the
33    plates to be issued  as  vanity  plates  or  personalized  in

 1    accordance with Section 3-405.1 of this Code.  The plates are
 2    not required to designate "Land of Lincoln", as prescribed in
 3    subsection  (b) of Section 3-412 of this Code.  The Secretary
 4    of State shall prescribe stickers or decals as provided under
 5    Section 3-412.
 6        (c)  An applicant shall be charged a $27 fee for original
 7    issuance in addition to the applicable registration fee.  Of
 8    this  additional  fee,  $15  shall  be  deposited  into   the
 9    Secretary  of  State Special License Plate Fund and $12 shall
10    be deposited into the Illinois Fire Fighters' Memorial  Fund.
11    For  each registration renewal period, a $17 fee, in addition
12    to the appropriate registration fee, shall be  charged.    Of
13    this  fee,  $2 shall be deposited into the Secretary of State
14    Special License Plate Fund and $15 shall  be  deposited  into
15    the Illinois Fire Fighters' Memorial Fund.
16        (d)  In  addition  to  the  purpose  specified in Section
17    2-119(n), moneys in the Illinois Fire Fighters' Memorial Fund
18    shall, subject to appropriation by the General  Assembly  and
19    approval  by  the  Secretary,  be  used  for  maintaining the
20    Illinois Fire  Fighters'  Memorial,  for  holding  an  annual
21    memorial  commemoration,  and  for  providing scholarships to
22    children of fire fighters killed in the line of duty.

24        Section 99. Effective date.  This Act takes  effect  upon
25    becoming law.
