1 AN ACT to amend the Clerks of Courts Act by adding
2 Section 30.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Clerks of Courts Act is amended by adding
6 Section 30 as follows:
7 (705 ILCS 105/30 new)
8 Sec. 30. Legal counsel. The circuit clerk in each
9 respective county may appoint either full-time or part-time
10 an Illinois licensed attorney at law to represent the office
11 of the circuit clerk in the collection of any debt due and
12 owing the circuit clerk; collection of child support
13 administrative fees; reviewing of contracts regarding the
14 circuit clerk's office; and collection of dishonored checks
15 and unpaid fees. The county board authorization for the
16 appointment of a legal counsel must be indicated by the line
17 item inclusion in the annual appropriation and budget
18 ordinance of the county board for the operations of the
19 circuit clerk in each respective county. The legal counsel
20 is vested with the same tort immunity as the clerk of the
21 circuit court. The appointment of a legal counsel by the
22 circuit clerk does not relieve either the Attorney General or
23 the State's Attorney of his or her respective county of the
24 duty to defend the officers, agents, and employees of the
25 county in any litigation against the circuit clerk.
26 Section 99. Effective date. This Act takes effect upon
27 becoming law.
