91_HB2838 LRB9105315PTpk 1 AN ACT to amend the Illinois Health Finance Reform Act by 2 changing Sections 2-2 and 2-6. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Health Finance Reform Act is 6 amended by changing Sections 2-2 and 2-6 as follows: 7 (20 ILCS 2215/2-2) (from Ch. 111 1/2, par. 6502-2) 8 Sec. 2-2. Council Duties. The Council shall be 9 responsible for: 10 (a) Collecting and publicizing hospital financing and 11 cost data pursuant to Article IV for the purposes of carrying 12 out its duties under this Act. 13 (b) Studying the health care financing system in the 14 State of Illinois, and recommending to the General Assembly 15 what it deems to be the most appropriate and comprehensive 16 cost containment system for the State. In its deliberations, 17 the Council shall consider: 18 (1) The health care delivery system in the State of 19 Illinois and hospitals' role in that system; 20 (2) Minimizing cost shifting between publicly 21 supported patients and private payors; 22 (3) The quality of care provided by hospitals as it 23 relates to their level of reimbursement; 24 (4) Cost containment alternatives for Illinois 25 State employees' health benefit plans currently available 26 under Illinois law; 27 (5) The efficacy of current certificate of need 28 processes under the Illinois Health Facilities Planning 29 Act and possible alternative measures to contain costs, 30 including capital expenditure caps; 31 (6) The efficacy of the current State health -2- LRB9105315PTpk 1 planning process; 2 (7) The efficacy of State bonding authorities for 3 health facilities construction and development; 4 (8) The financial hardships experienced by 5 hospitals primarily serving the poor;and6 (9) Accessibility of hospital care;.7 (10) The cost of prescription drugs and the impact 8 of this element of the health care delivery system on the 9 cost of hospital care and treatment, the cost of health 10 insurance, and the out-of-pocket cost of medical care for 11 individuals; and 12 (11) The availability of prescription drug price 13 information to consumers and methods for improving more 14 effective procurement and utilization of prescription 15 drugs and pharmacy services by hospitals, other health 16 care institutions, and individual consumers. 17 (c) Monitoring the extent to which hospitals in general 18 and each individual hospital in the State limit price 19 increases to the rate of increase of prices in the general 20 economy. 21 (d) Promoting and counseling the general public on more 22 effective procurement and utilization of health services, 23 through a special Health Care Consumer Affairs Advisor to be 24 employed by the Council. 25 (Source: P.A. 83-1243.) 26 (20 ILCS 2215/2-6) (from Ch. 111 1/2, par. 6502-6) 27 Sec. 2-6. Council Reports. 28 (a) The Council shall make an interim report to the 29 General Assembly not later than July 1, 1985, which shall 30 include: 31 (1) The Council's findings and recommendations 32 regarding its duties as provided under subsection (a) of 33 Section 2-2. -3- LRB9105315PTpk 1 (2) The Council's findings and recommendations on 2 the health care financing and delivery system in Illinois 3 as provided under subsection (b) of Section 2-2. 4 (b) The Council shall make a final report to the General 5 Assembly not later than March 1, 1986, which shall include: 6 (1) The Council's final findings and 7 recommendations regarding its duties as provided under 8 subsection (a) of Section 2-2. 9 (2) The Council's final findings and 10 recommendations on the health care financing and delivery 11 system in Illinois as provided under subsection (b) of 12 Section 2-2. 13 (c) The Council shall report on whether aggregate 14 hospital prices during calendar year 1984 increased by more 15 than the increase of prices in the general economy for such 16 calendar year, and shall identify any individual hospitals 17 whose prices increased by more than the increase of prices in 18 the general economy, by February 28, 1985. 19 (d) The Council shall report on whether aggregate 20 hospital prices during calendar year 1985 increased by more 21 than the increase of prices in the general economy for such 22 calendar year, and shall identify any individual hospitals 23 whose prices increased by more than the increase of prices in 24 the general economy, by February 28, 1986. 25 (e) If aggregate hospital prices increased by more than 26 the increase of prices in the general economy in either 1984 27 or 1985, the Council shall recommend to the General Assembly 28 by March 1 of the year following the year in which such 29 excess price increase occurred specific steps to prevent, 30 either through regulation or other approaches, any further 31 excess price increase. 32 (f) The Council shall submit to the General Assembly on 33 or before January 1, 2003 a report and recommendation 34 concerning paragraphs (10) and (11) of subsection (b) of -4- LRB9105315PTpk 1 Section 2-2. 2 (Source: P.A. 83-1243.)
