1 AN ACT to amend the Nursing Home Care Act by adding
2 Section 3-212.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Nursing Home Care Act is amended by
6 adding Section 3-212.1 as follows:
7 (210 ILCS 45/3-212.1 new)
8 Sec. 212.1. Surveyors; standards of conduct.
9 (a) All Department personnel who conduct surveys must
10 follow the professional standards of their particular
11 profession, be it nursing, dietetics, sanitation, or
12 architecture.
13 (b) No person conducting a survey shall survey a facility
14 in which he or she has been employed in the past 10 years.
15 For the purpose of this subsection, employment includes
16 consulting services.
17 (c) There is hereby created a Nursing Facility
18 Professional Standards Review Board. The Board shall consist
19 of 5 members appointed by the Governor, three of whom are
20 registered nurses and have at least a master's degree in
21 nursing, one of whom is a dietitian certified by the American
22 Dietetic Association, and one of whom is a registered
23 environmental health practitioner. The Board shall have the
24 following duties:
25 (1) establishing procedures for a facility to file
26 a complaint against an individual who is conducting a
27 survey and has behaved unprofessionally;
28 (2) investigating complaints filed with the Board;
29 and
30 (3) recommending disciplinary actions to the
31 appropriate professional board.
