91_HB2550 LRB9102288DJcdA 1 AN ACT to amend the Illinois Human Rights Act by changing 2 Section 5-102. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Human Rights Act is amended by 6 changing Section 5-102 as follows: 7 (775 ILCS 5/5-102) (from Ch. 68, par. 5-102) 8 Sec. 5-102. Civil Rights Violations: Public 9 Accommodations. 10 It is a civil rights violation for any person on the 11 basis of unlawful discrimination to: 12 (A) Enjoyment of Facilities. Deny or refuse to 13 another the full and equal enjoyment of the facilities 14 and services of any public place of accommodation; 15 (B) Written Communications. Directly or indirectly, 16 as the operator of a place of public accommodation, 17 publish, circulate, display or mail any written 18 communication, except a private communication sent in 19 response to a specific inquiry, which the operator knows 20 is to the effect that any of the facilities of the place 21 of public accommodation will be denied to any person or 22 that any person is unwelcome, objectionable or 23 unacceptable because of unlawful discrimination; 24 (C) Public Officials. Deny or refuse to another, as 25 a public official, the full and equal enjoyment of the 26 accommodations, advantage, facilities or privileges of 27 the official's office or services or of any property 28 under the official's care because of unlawful 29 discrimination. 30 It is a civil rights violation for any person to restrict 31 an individual's access or admission to, or usage of, a place -2- LRB9102288DJcdA 1 of public accommodation solely because the individual 2 operates a motorcycle. This paragraph does not prohibit a 3 person from restricting an individual's access or admission 4 to, or usage of, a place of public accommodation because the 5 individual's conduct poses a risk to the health, safety, or 6 property of another. 7 (Source: P.A. 81-1216.)
