91_HB2349 LRB9104834RCks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 33D-1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 33D-1 as follows: 7 (720 ILCS 5/33D-1) (from Ch. 38, par. 33D-1) 8 Sec. 33D-1. (a) Contributing to the criminal delinquency 9 of a juvenile. Any person of the age of 21 years and upwards, 10 who with the intent to promote or facilitate the commission 11 of an offense that is either a felony or misdemeanora felony12, solicits, compels or directs any person under the age of 17 13 years in the commission of the offensesuch felonycommits 14 the offense of contributing to the criminal delinquency of a 15 juvenile. 16 (b) Sentence. Contributing to the criminal delinquency 17 of a juvenile is a felony one grade higher than the offense 18 committed, if the offense committed is a felony, except when 19 the offense committed is first degree murder or a Class X 20 felony. When the offense committed is first degree murder or 21 a Class X felony, the penalty for contributing to the 22 criminal delinquency of a juvenile is the same as the penalty 23 for first degree murder or a Class X felony, respectively. 24 Contributing to the criminal delinquency of a juvenile is a 25 misdemeanor one grade higher than the offense committed, if 26 the offense committed is a misdemeanor, except when the 27 offense committed is a Class A misdemeanor. If the offense 28 committed is a Class A misdemeanor, the penalty for 29 contributing to the criminal delinquency of a juvenile is a 30 Class 4 felony. 31 (Source: P.A. 85-906.)
