91_HB2343eng HB2343 Engrossed LRB9105126MWgc 1 AN ACT to amend the Plat Act by changing Section 3. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Plat Act is amended by changing Section 3 5 as follows: 6 (765 ILCS 205/3) (from Ch. 109, par. 3) 7 Sec. 3. The acknowledgment and recording of such plat, or 8 the acknowledgment and the filing of the same shall be held 9 in all courts to be a conveyance in fee simple of such 10 portions of the premises platted as are marked or noted on 11 such plat as donated or granted to the public, or any person, 12 religious society, corporation or body politic, and as a 13 general warranty against the donor, his or her heirs and 14 representatives, to such donee or grantee, for their use or 15 for the use and purposes therein named or intended, and for 16 no other use or purpose; and the premises intended for any 17 street, alley, way, common or other public use in any city, 18 village or town, or addition thereto, shall be held in the 19 corporate name thereof in trust to and for the uses and 20 purposes set forth or intended. 21 The location and construction of municipal utilities is 22 an intended use of a fee simple right-of-way dedication, 23 provided that all jurisdictions with an interest in the 24 right-of-way permit the installation of the municipal 25 utilities. 26 (Source: P.A. 83-345.)
