91_HB2287enr HB2287 Enrolled LRB9105125MWpk 1 AN ACT to amend the Public Building Commission Act by 2 changing Section 5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Building Commission Act is amended 6 by changing Section 5 as follows: 7 (50 ILCS 20/5) (from Ch. 85, par. 1035) 8 Sec. 5. Within 60 days after the filing in the office of 9 the recorder of the resolution or resolutions organizing the 10 Public Building Commission, the presiding officer of the 11 municipality, county seat or county board adopting the 12 original resolution and the presiding officers of the 13 municipal corporations, if any, joining in the organization 14 of the Public Building Commission shall appoint Commissioners 15 in the manner hereinafter provided. All appointments shall 16 be made with the advice and consent of the governing body 17 whose presiding officer makes the appointment. 18 Within 10 days after the appointment of the commissioners 19 by the respective presiding officers, with the advice and 20 consent of the respective governing bodies, as aforesaid, 21 each of such presiding officers shall transmit to the 22 presiding officer of the municipality, county seat or county 23 board which adopted the original resolution, a certificate of 24 such appointment. The presiding officer of the municipality, 25 county seat or county board shall cause all such certificates 26 of appointment, including a certificate of the appointments 27 made by the presiding officer of the municipality, county 28 seat or county board which adopted the original resolution, 29 to be bound under one cover and filed in the office of the 30 recorder in and for the county. Upon such filing the persons 31 so appointed shall constitute the Board of Commissioners of HB2287 Enrolled -2- LRB9105125MWpk 1 the Public Building Commission and upon taking the oath of 2 office as hereinafter provided shall be deemed to have 3 qualified and be empowered to exercise the powers and 4 authority prescribed in this Act. 5 The Board of Commissioners shall in all cases consist of 6 not less than 5 members and in such instances as there may be 7 more than 5 members as herein provided, the Board of 8 Commissioners shall consist of an odd number. 9 If the county seat or municipality alone organizes the 10 Public Building Commission, the presiding officer of the 11 county seat or municipality shall appoint not less than 5 12 Commissioners. 13 If the county board alone organized the Public Building 14 Commission, the presiding officer of the county board shall 15 appoint not less than 5 Commissioners. The Commissioners 16 appointed to that Public Building Commission must be 17 residents of the county in which the Commission is organized. 18 19 If any one municipal corporation shall join with the 20 municipality, county seat or county board in the organization 21 of the Public Building Commission then and in such event the 22 presiding officer of the municipality, county seat or county 23 board adopting the original resolution shall appoint 3 24 Commissioners and the presiding officer of the municipal 25 corporation joining in the organization of the Public 26 Building Commission shall appoint 2 Commissioners. 27 If 2 or more municipal corporations, in addition to the 28 municipality, county seat or county board adopting the 29 original resolution, shall join with the municipality, county 30 seat or county board in the organization of the Public 31 Building Commission then and in such event the presiding 32 officers of the municipal corporations joining in the 33 organization shall each appoint 1 Commissioner and the 34 presiding officer of the municipality, county seat or county HB2287 Enrolled -3- LRB9105125MWpk 1 board adopting the original resolution shall appoint such 2 number of commissioners as shall exceed by 1 the aggregate 3 number appointed by the presiding officers of the municipal 4 corporations joining in the organization of the Commission. 5 The initial terms of such Commissioners shall be for 5, 6 4, 3, 2 and 1 year, respectively, and in such cases as there 7 may be more than 5 Commissioners the initial terms of 8 Commissioners in excess of 5 Commissioners shall be on a 9 descending scale of 5, 4, 3, 2 and 1 years, as there are 10 Commissioners in excess of 5. The length of the terms of the 11 first Commissioners shall be determined by lot at their first 12 meeting. The initial terms of office of Commissioners who 13 are to hold office for terms of 1, 2, 3, 4 and 5 years, 14 respectively, shall continue until that September 30th which 15 next follows the expiration of the periods of 1, 2, 3, 4 and 16 5 years, respectively, from the date of the filing of the 17 certificates of appointment in the office of the recorder, as 18 aforesaid, and until their successors are appointed and 19 qualify by taking their oath of office. 20 At the expiration of the term of each of the 21 Commissioners, and of each succeeding Commissioner, or in the 22 event of a vacancy, resignation, removal or refusal to act, 23 the presiding officer of the municipal corporation, who made 24 that Commissioner's appointment in the first instance, shall 25 appoint a Commissioner, in the manner hereinabove provided, 26 to hold office, in the case of a vacancy occurring for 27 whatever reason, for the unexpired term, or in the case of 28 expiration, for a term of 5 years, and until his successor is 29 appointed and has qualified. Each such appointment shall 30 become effective upon the filing by the presiding officer 31 making the appointment of a certificate of the appointment in 32 the office of the recorder for that county.
