91_HB2264 LRB9104855ACtm 1 AN ACT to amend the Private Sewage Disposal Licensing Act 2 by changing Section 4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Private Sewage Disposal Licensing Act is 6 amended by changing Section 4 as follows: 7 (225 ILCS 225/4) (from Ch. 111 1/2, par. 116.304) 8 Sec. 4. (a) After January 1, 1974, no person or private 9 sewage disposal system contractor may construct, install, 10 modify, repair, maintain, or service a private sewage 11 disposal system or transport and dispose of waste removed 12 therefrom, in such a manner that does not comply with the 13 requirements of this Act and the private sewage disposal code 14 promulgated hereunder by the Department. A person who owns 15 and occupies a single family dwelling and who constructs, 16 installs, maintains, services or cleans the private sewage 17 disposal system which serves his single family residence 18 shall not be required to be licensed under this Act, however, 19 such person shall comply with all other provisions of this 20 Act and the private sewage disposal code promulgated 21 hereunder by the Department. 22 Any person who constructs, installs, repairs, modifies, 23 or maintains a private sewage disposal system, other than a 24 system which serves his own single family residence, shall be 25 licensed by the Department as a Private Sewage System 26 Installation Contractor and any person who cleans or pumps 27 waste from a private sewage disposal system, other than a 28 system which serves his own single family residence, or hauls 29 or disposes of wastes removed therefrom shall be licensed by 30 the Department as a Private Sewage Disposal System Pumping 31 Contractor in accordance with this Act. -2- LRB9104855ACtm 1 (b) No new private sewage disposal system shall be 2 installed by any person until drawings, specifications and 3 other information requested by the Department are submitted 4 to and reviewed by the Department and found to comply with 5 the private sewage disposal code, and until approval for the 6 installation of such system is issued by the Department. The 7 Department shall either approve or deny the installation of 8 the new system, in writing, within 90 days after the drawings 9 and specifications are submitted. 10 (c) The licensing requirements of this Act shall not 11 apply to any person who cleans or pumps, hauls or disposes of 12 waste from chemical toilets located in an underground coal 13 mine. This waste shall be (i) transported to and disposed of 14 at a sewage treatment facility permitted by the Illinois 15 Environmental Protection Agency and located on the mine 16 property, or (ii) stored on-site in a sanitary manner pending 17 removal and subsequent disposal by a licensed private sewage 18 disposal pumping contractor. 19 (Source: P.A. 86-1195.)
