1 AN ACT to amend the Illinois Procurement Code by adding
2 Section 30-22.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Procurement Code is amended by
6 adding Section 30-22 as follows:
7 (30 ILCS 500/30-22 new)
8 Sec. 30-22. Construction contracts; responsible bidder
9 requirements. To be considered a responsible bidder on a
10 construction contract for purposes of this Code, a bidder
11 must comply with all of the following requirements and must
12 present satisfactory evidence of that compliance to the
13 appropriate construction agency:
14 (1) The bidder must comply with all applicable laws
15 concerning the bidder's entitlement to conduct business
16 in Illinois.
17 (2) The bidder must comply with all applicable
18 provisions of the Prevailing Wage Act.
19 (3) The bidder must comply with Subchapter VI
20 ("Equal Employment Opportunities") of Chapter 21 of Title
21 42 of the United States Code (42 U.S.C. 2000e and
22 following) and with Federal Executive Order No. 11246 as
23 amended by Executive Order No. 11375.
24 (4) The bidder must have a valid Federal Employer
25 Identification Number or, if an individual, a valid
26 Social Security Number.
27 (5) The bidder must have a valid certificate of
28 insurance showing the following coverages: general
29 liability, professional liability, product liability,
30 workers' compensation, completed operations, hazardous
31 occupation, and automobile.

1 (6) The bidder must participate in apprenticeship
2 and training programs approved by and registered with the
3 United States Department of Labor's Bureau of
4 Apprenticeship and Training.
