91_HB2171eng HB2171 Engrossed LRB9103796SMdv 1 AN ACT to amend the Illinois Public Aid Code by changing 2 Section 5-4.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Public Aid Code is amended by 6 changing Section 5-4.1 as follows: 7 (305 ILCS 5/5-4.1) (from Ch. 23, par. 5-4.1) 8 Sec. 5-4.1. Co-payments. The Department may by rule 9 provide that recipients under any Article of this Code (other 10 than group care recipients) shall pay a fee as a co-payment 11 for services. Co-payments may not exceed $1one dollarfor 12 pharmacy services, physicians services, dental services, 13 optical services and supplies, chiropractic services, 14 podiatry services, and encounter rate clinic services. 15 Co-payments may not exceed $3three dollarsfor hospital 16 outpatient and clinic services. Provided, however, that any 17 such rule must provide that no co-payment requirement can 18 exist for renal dialysis, radiation therapy, cancer 19 chemotherapy, or insulin, and other products necessary on a 20 recurring basis, the absence of which would be life 21 threatening, or where co-payment expenditures for required 22 services and/or medications for chronic diseases that the 23 Illinois Department shall by rule designate shall cause an 24 extensive financial burden on the recipient, and provided no 25 co-payment shall exist for emergency room encounters which 26 are for medical emergencies. 27 (Source: P.A. 82-664.)
