91_HB2167eng HB2167 Engrossed LRB9103955SMdv 1 AN ACT to amend the Illinois Public Aid Code by changing 2 Sections 4-1.12 and 9A-4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Public Aid Code is amended by 6 changing Sections 4-1.12 and 9A-4 as follows: 7 (305 ILCS 5/4-1.12) 8 Sec. 4-1.12. Five year limitation. 9 (a) No assistance unit shall be eligible for a cash 10 grant under this Article if it includes an adult who has 11 received cash assistance as an adult for 60 months, whether 12 or not consecutive, after the effective date of this 13 amendatory Act of 1997. The Illinois Department may exempt 14 individual assistance units from the 60-month limitation or 15 determine circumstances under which a month or months would 16 not count towards the 60-month limitation even though the 17 assistance unit did receive cash assistance under this 18 Article. 19 (b) In addition to the months that the Department has 20 determined or will determine by rule not to count toward the 21 60 month limitation, the Department shall not count months in 22 which the adult receiving assistance under this Article is 23 the primary caregiver for a child in the assistance unit 24 under the age of 6 and is employed and earning income, or 25 engaged in self-employment for an average of 20 hours per 26 week. 27 (Source: P.A. 90-17, eff. 7-1-97.) 28 (305 ILCS 5/9A-4) (from Ch. 23, par. 9A-4) 29 Sec. 9A-4. Participation. 30 (a) Except for those exempted under subsection (b) HB2167 Engrossed -2- LRB9103955SMdv 1 below, and to the extent resources permit, the Illinois 2 Department as a condition of eligibility for public aid, may, 3 as provided by rule, require all recipients to participate in 4 an education, training, and employment program, which shall 5 include accepting suitable employment and refraining from 6 terminating employment or reducing earnings without good 7 cause. 8 (b) Recipients shall be exempt from the requirement of 9 participation in the education, training, and employment 10 program in the following circumstances: 11 (1) The recipient is a person over age 60; or 12 (2) The recipient is a person with a child under 13 age one. 14 (c) The Department shall not require recipients who are 15 the primary caregiver for a child in the assistance unit 16 under the age of 6 to participate in the education, training, 17 and employment program more than 20 hours each week. 18 (Source: P.A. 89-6, eff. 3-6-95; 90-17, eff. 7-1-97.) 19 Section 99. Effective date. This Act takes effect upon 20 becoming law.
