91_HB2130eng HB2130 Engrossed LRB9100757MWgc 1 AN ACT to amend the Fire Protection District Act by 2 adding Section 11h. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Fire Protection District Act is amended 6 by adding Section 11h as follows: 7 (70 ILCS 705/11h new) 8 Sec. 11h. Regulation of alarms; unfounded alarms; 9 charge. The board of trustees of any fire protection 10 district may, by ordinance, regulate fire and other emergency 11 alarm systems operated within the district. The district may 12 assess charges against the end user customer who uses an 13 alarm system for unfounded alarms that exceed (i) 4 alarms 14 during any 30-day period or (ii) 6 alarms during any 12-month 15 period. For the purposes of this Section, "unfounded alarm" 16 includes (i) any alarm notification activated due to a 17 mechanical or other failure or (ii) any alarm activated by a 18 property or location owner, resident, manager, occupant, 19 guest, or other person on the premises when no fire or other 20 bona fide emergency is occurring on the premises. 21 A charge may not be assessed when (i) the responding fire 22 department is notified, before fire department personnel and 23 equipment departs in response to the alarm, that the alarm is 24 unfounded or (ii) the alarm system is being installed, 25 repaired, maintained, or tested and the fire department is 26 notified of those activities before the activities begin. 27 The amount of the charge assessed for unfounded alarms 28 may not exceed $500 per alarm.
