91_HB2124 LRB9105105RCks 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 changing Section 108A-10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by changing Section 108A-10 as follows: 7 (725 ILCS 5/108A-10) (from Ch. 38, par. 108A-10) 8 Sec. 108A-10. Appeal by State. In addition to any other 9 right to appeal, the State hasshall havethe right to appeal 10 from a denial of an application for an order of authorization 11 or approval and the right to appeal the granting of a motion 12 to suppress. 13 Where the State appeals, such appeal shall be taken 14 within 30 days after the date the order was denied or motion 15 granted and shall be diligently prosecuted. 16 (Source: P.A. 79-1159.)
