91_HB2024 LRB9104348KSks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 7-2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 7-2 as follows: 7 (720 ILCS 5/7-2) (from Ch. 38, par. 7-2) 8 Sec. 7-2. Use of force in defense of dwelling. 9 A person is justified in the use of force against another 10 when and to the extent that he or she reasonably believes 11 that such conduct is necessary to prevent or terminate such 12 other's unlawful entry into or attack upon a dwelling. 13 However, he or she is justified in the use of force which is 14 intended or likely to cause death or great bodily harm only 15 if: 16 (a) The entry is made or attempted in a violent, 17 riotous, or tumultuous manner, and he reasonably believes 18 that such force is necessary to prevent an assault upon, or 19 offer of personal violence to, him or her or another then in 20 the dwelling, or 21 (b) He or she reasonably believes that such force is 22 necessary to prevent the commission of a felony in the 23 dwelling. 24 (Source: Laws 1967, p. 696.)
