91_HB2021 LRB9103162WHdv 1 AN ACT to amend the Illinois Public Aid Code by changing 2 Section 4-1.12. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Public Aid Code is amended by 6 changing Section 4-1.12 as follows: 7 (305 ILCS 5/4-1.12) 8 Sec. 4-1.12. Five year limitation. 9 (a) No assistance unit shall be eligible for a cash 10 grant under this Article if it includes an adult who has 11 received cash assistance as an adult for 60 months, whether 12 or not consecutive, after the effective date of this 13 amendatory Act of 1997. The Illinois Department may exempt 14 individual assistance units from the 60-month limitation or 15 determine circumstances under which a month or months would 16 not count towards the 60-month limitation even though the 17 assistance unit did receive cash assistance under this 18 Article. 19 (b) In addition to months that the Illinois Department 20 has determined or shall determine by rule not to count toward 21 the 60-month limitation, the Illinois Department shall not 22 count the following months: 23 (1) Months in which the adult receiving assistance 24 under this Article is the primary caregiver for a child 25 under the age of one in the assistance unit. 26 (2) Months in which the adult receiving assistance 27 under this Article is the primary caregiver for a 28 disabled family member, as defined by the Illinois 29 Department in rules, when the demands of caregiving are 30 inconsistent with sustained employment. 31 (3) Months in which the adult receiving assistance -2- LRB9103162WHdv 1 under this Article has a pending application for federal 2 Supplemental Security Income benefits based upon 3 disability as to which (A) the Illinois Department has 4 made a determination that the adult has a reasonable 5 likelihood of success and (B) the Social Security 6 Administration has not issued an unfavorable 7 determination after a hearing. 8 (4) Months in which the adult receiving assistance 9 is determined by the Illinois Department under Section 10 4-22 to need to engage in activities to address a 11 domestic violence situation to an extent inconsistent 12 with sustained employment. 13 (5) Months in which the adult receiving assistance 14 under this Article is employed and earning income, or 15 engaged in self-employment activities, for an average of 16 20 hours per week. 17 (Source: P.A. 90-17, eff. 7-1-97.)
