91_HB1965eng HB1965 Engrossed LRB9104624DJcb 1 AN ACT to amend the State's Attorneys Appellate 2 Prosecutor's Act by changing Section 3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The State's Attorneys Appellate Prosecutor's 6 Act is amended by changing Section 3 as follows: 7 (725 ILCS 210/3) (from Ch. 14, par. 203) 8 Sec. 3. There is created the Office of the State's 9 Attorneys Appellate Prosecutor as an agency of state 10 government. 11 (a) The Office of the State's Attorneys Appellate 12 Prosecutor shall be governed by a board of governors which 13 shall consist of 10 members as follows: 14 (1) Eight State's Attorneys, 2 to be elected from each 15 District containing less than 3,000,000 inhabitants; 16 (2) The State's Attorney of Cook County; and 17 (3) One State's Attorney to be appointed by the other 9 18 members. 19 (b) Voting for elected members shall be by District with 20 each of the State's Attorneys voting from their respective 21 district. Each board member must be duly elected or 22 appointed and serving as State's Attorney in the district 23 from which he was elected or appointed. 24 (c) Members shall serve for a term of 2 yearsone year25 commencing on the first day of July, 1999, and until their 26 successors are duly elected or appointed and qualified. 27 (d) Anannualelection of members of the board shall be 28 held during the month of June, 1999, and every 2 years 29 thereafter. The board shall certify the results of each 30 election to the Secretary of State. 31 (e) The board shall promulgate rules of procedure for HB1965 Engrossed -2- LRB9104624DJcb 1 the election of its members and the conduct of its meetings 2 and shall elect a Chairman and a Vice-Chairman and such other 3 officers as it deems appropriate. The board shall meet at 4 least once every 3 months, and in addition thereto as 5 directed by the Chairman, or upon the special call of any 5 6 members of the board, in writing, sent to the Chairman, 7 designating the time and place of the meeting. 8 (f) Five members of the board shall constitute a quorum 9 for the purpose of transacting business. 10 (g) Members of the board shall serve without 11 compensation, but shall be reimbursed for necessary expenses 12 incurred in the performance of their duties. 13 (h) A position shall be vacated by either a member's 14 resignation, removal or inability to serve as State's 15 Attorney. 16 (i) Vacancies on the board of elected members shall be 17 filled within 9030days of the occurrence of the vacancy by 18 a special election ofheld bythe State's Attorneys ofinthe 19 district where the vacancy occurred. A vacancyVacancies on20the boardof antheappointed member of the board shall be 21 filled within 9030daysof the occurrence of the vacancyby 22 a special election by the members of the board. A member 23 elected or appointed to fill a vacancysuch positionshall 24 serve for the unexpired term of the member whom he is 25 succeeding. Any member may be re-elected or re-appointed for 26 additional terms. 27 (Source: P.A. 84-1062.) 28 Section 99. Effective date. This Act takes effect upon 29 becoming law.
