91_HB1894 LRB9104337EGfg 1 AN ACT to amend the Illinois Pension Code by changing 2 Section 14-104.10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Section 14-104.10 as follows: 7 (40 ILCS 5/14-104.10) 8 Sec. 14-104.10. Federal or out-of-state employment. A 9 contributing employee may establish additional service credit 10 for periods of full-time employment by the federal government 11 or a unit of state or local government located outside 12 Illinois for which he or she does not qualify for credit 13 under any other provision of this Article, provided that (i) 14 the amount of service credit established by a person under 15 this Section shall not exceed 8 years or 40% of his or her 16 membership service under this Article, whichever is less, 17 (ii) the amount of service credit established by a person 18 under this Section for federal employment, when added to the 19 amount of all military service credit granted to the person 20 under this Article, shall not exceed 8 years, and (iii) any 21 credit received for the federal or out-of-state employment in 22 any federal or other public employee pension fund or 23 retirement system has been terminated or relinquished. 24 Credit may not be established under this Section for any 25 period of military service or for any period for which credit 26 has been or may be established under Section 14-110 or any 27 other provision of this Article. 28 In order to establish service credit under this Section, 29 the applicant must submit a written application to the System 30by June 30, 1999, including documentation of the federal or 31 out-of-state employment satisfactory to the Board, and pay to -2- LRB9104337EGfg 1 the System (1) employee contributions at the rates provided 2 in this Article based upon the person's salary on the last 3 day as a participating employee prior to the federal or 4 out-of-state employment, or on the first day as a 5 participating employee after that employment, whichever is 6 greater, plus (2) an amount determined by the Board to be 7 equal to the employer's normal cost of the benefits accrued 8 for that employment, plus (3) regular interest on items (1) 9 and (2) from the date of conclusion of the employment to the 10 date of payment. 11 (Source: P.A. 90-32, eff. 6-27-97; 90-655, eff. 7-30-98; 12 90-766, eff. 8-14-98.) 13 Section 99.
