91_HB1862 LRB9104837DJcd 1 AN ACT to amend the Illinois Abortion Law of 1975 by 2 adding Section 6.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Abortion Law of 1975 is amended 6 by adding Section 6.5 as follows: 7 (720 ILCS 510/6.5 new) 8 Sec. 6.5. Minor resident of another state. 9 (a) In this Section, "minor" means a female under 18 10 years of age. 11 (b) If (i) a minor who is a resident of a state 12 bordering this State comes to this State for the purpose and 13 with the intention of obtaining an abortion and (ii) there is 14 in effect in that other state a law requiring parental 15 consent or parental notification before an abortion may be 16 performed on the minor, then the minor may not obtain an 17 abortion in this State until there is compliance with that 18 parental consent or parental notification law. 19 (c) A minor who is a resident of a state bordering this 20 State, who comes to this State for the purpose and with the 21 intention of obtaining an abortion without parental consent 22 in order to avoid complying with a parental consent or 23 parental notification law of that other state, and who 24 obtains an abortion in this State commits a Class 4 felony. 25 (d) A physician who performs an abortion on a minor, 26 knowing that the minor is a resident of a state bordering 27 this State and has come to this State for the purpose and 28 with the intention of obtaining an abortion without parental 29 consent in order to avoid complying with a parental consent 30 or parental notification law of that other state, commits a 31 Class 4 felony.
