91_HB1856 LRB9103353LDmb 1 AN ACT to amend the Consumer Fraud and Deceptive Business 2 Practices Act by adding Section 2JJ. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Consumer Fraud and Deceptive Business 6 Practices Act is amended by adding Section 2JJ as follows: 7 (815 ILCS 505/2JJ new) 8 Sec. 2JJ. Gambling advertising. 9 (a) It is an unlawful practice for any person, whether 10 the person is in Illinois or not, to send any advertising or 11 solicitation relating to gambling or a gambling establishment 12 to a person in Illinois without including on the 13 advertisement or solicitation a statement regarding obtaining 14 assistance with gambling problems and including the toll-free 15 "800" telephone number maintained by the Department of Human 16 Services under Section 5-20 of the Alcoholism and Other Drug 17 Abuse and Dependency Act. 18 (b) Any person who violates this Section shall be 19 subject to a civil penalty of $1 per piece of advertising or 20 $1,000, whichever is greater, but not to exceed $50,000 per 21 day. Each day that a piece of advertising is received by 22 someone in Illinois without the statement required under this 23 Section constitutes a separate violation. An action may be 24 brought against a person who violates this Section in a court 25 of competent jurisdiction by the Department of Human Services 26 on its own motion or pursuant to the complaint of any 27 resident of this State.
