1 AMENDMENT TO HOUSE BILL 1822
2 AMENDMENT NO. . Amend House Bill 1822 as follows:
3 on page 1, below line 18, by inserting the following:
4 "Devastating insect or plant disease - An insect or plant
5 disease, for which a quarantine exists, that the Director
6 determines could have a serious and devastating effect on the
7 nursery industry or environment."; and
8 on page 4, below line 11, by inserting the following:
9 "IV. A fine of not less than $500 but not greater than
10 $5,000 shall be imposed for each of the following violations
11 related to a devastating insect or plant disease:
12 A. Thwarting or hindering an inspection by
13 misrepresenting or concealing facts or conditions related
14 to compliance with the terms of the quarantine.
15 B. Selling, offering for sale, or distributing
16 nursery stock or other articles infested with devastating
17 insects or plant diseases in violation of the quarantine.
18 C. Failing to carry out the treatment or
19 destruction of any devastating insect or plant disease or
20 regulated article as required under the terms of the
21 quarantine and in accordance with official notification
22 from the Director.

1 D. Moving any regulated article into or out of the
2 quarantined area unless the regulated article has been
3 treated or handled as provided by the requirements of the
4 quarantine.
5 E. Falsifying a compliance agreement under the
6 quarantine.".
