91_HB1773eng HB1773 Engrossed LRB9103992WHdv 1 AN ACT to amend the Good Samaritan Act by changing 2 Section 12. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Good Samaritan Act is amended by changing 6 Section 12 as follows: 7 (745 ILCS 49/12) 8 Sec. 12. Use of an automatic external defibrillator; 9 exemption from civil liability for emergency care. 10 (a) Any person who has successfully completed the 11 training requirements of a course in basic emergency care of 12 a person in cardiac arrest that: 13 (i) included training in the operation and use of 14 an automatic external defibrillator; and 15 (ii) was conducted in accordance with the standards 16 of the American Heart Association or the American Red 17 Cross, 18 and who, in good faith, not for compensation, renders 19 emergency medical care involving the use of an automatic 20 external defibrillator in accordance with his or her 21 training is not liable for any civil damages as a result of 22 any act or omission, except for willful and wanton 23 misconduct, by that person in rendering that care. 24 (b) A person or entity that owns, occupies, or manages a 25 building or portion of a building in which a person meeting 26 the criteria set forth in subsection (a) renders emergency 27 medical care involving the use of an automatic external 28 defibrillator in accordance with subsection (a) is not liable 29 for any civil damages as a result of any act or omission, 30 except for willful and wanton misconduct, by the person 31 rendering that care.
