91_HB1731 LRB9103535SMdv 1 AN ACT to amend the Illinois Public Aid Code by changing 2 Section 10-2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Public Aid Code is amended by 6 changing Section 10-2 as follows: 7 (305 ILCS 5/10-2) (from Ch. 23, par. 10-2) 8 Sec. 10-2. Extent of Liability. A husband is liable for 9 the support of his wife and a wife for the support of her 10 husband. The parents are severally liable for the support of 11 any child under age 21, except that a parent is not liable 12 for a child age 18 or over if thesuchchild is not living 13 with the parent or parents, and a parent is not liable for a 14 child of any age if the child has married and is not living 15 with the parent or parents. A child shall be considered to be 16 living with the parent or parents if thesuchchild is absent 17 from the parent's or parents' home only in order to regularly 18 attend a school, college or university or to receive 19 technical training designed for preparation for gainful 20 employment. The term "child" includes a child born out of 21 wedlock, or legally adopted child. 22 In addition to the primary obligation of support imposed 23 upon responsible relatives, such relatives, if individually 24 or together in any combination they have sufficient income or 25 other resources to support a needy person, in whole or in 26 part, shall be liable for any financial aid extended under 27 this Code to a person for whose support they are responsible, 28 including amounts expended for funeral and burial costs. 29 (Source: P.A. 89-641, eff. 8-9-96; 90-18, eff. 7-1-97.)
