91_HB1707 LRB9102399KSgcA 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Section 2-119 and adding Section 3-806.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Section 2-119 and adding Section 3-806.5 as follows: 7 (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119) 8 Sec. 2-119. Disposition of fees and taxes. 9 (a) All moneys received from Salvage Certificates shall 10 be deposited in the Common School Fund in the State Treasury. 11 (b) Beginning January 1, 1990 and concluding December 12 31, 1994, of the money collected for each certificate of 13 title, duplicate certificate of title and corrected 14 certificate of title, $0.50 shall be deposited into the Used 15 Tire Management Fund. Beginning January 1, 1990 and 16 concluding December 31, 1994, of the money collected for each 17 certificate of title, duplicate certificate of title and 18 corrected certificate of title, $1.50 shall be deposited in 19 the Park and Conservation Fund. Beginning January 1, 1995, 20 of the money collected for each certificate of title, 21 duplicate certificate of title and corrected certificate of 22 title, $2 shall be deposited in the Park and Conservation 23 Fund. The moneys deposited in the Park and Conservation Fund 24 pursuant to this Section shall be used for the acquisition 25 and development of bike paths as provided for in Section 26 63a36 of the Civil Administrative Code of Illinois. Except as 27 otherwise provided in this Code, all remaining moneys 28 collected for certificates of title, and all moneys collected 29 for filing of security interests, shall be placed in the 30 General Revenue Fund in the State Treasury. 31 (c) All moneys collected for that portion of a driver's -2- LRB9102399KSgcA 1 license fee designated for driver education under Section 2 6-118 shall be placed in the Driver Education Fund in the 3 State Treasury. 4 (d) Beginning January 1, 1999, of the monies collected 5 as a registration fee for each motorcycle, motor driven cycle 6 and motorized pedalcycle, 27% of each annual registration fee 7 for such vehicle and 27% of each semiannual registration fee 8 for such vehicle is deposited in the Cycle Rider Safety 9 Training Fund. 10 (e) Of the monies received by the Secretary of State as 11 registration fees or taxes or as payment of any other fee, as 12 provided in this Act, except fees received by the Secretary 13 under paragraph (7) of subsection (b) of Section 5-101,and14 Section 5-109, and Section 3-608.5 of this Code, 37% shall be 15 deposited into the State Construction Fund. 16 (f) Of the total money collected for a CDL instruction 17 permit or original or renewal issuance of a commercial 18 driver's license (CDL) pursuant to the Uniform Commercial 19 Driver's License Act (UCDLA), $6 of the total fee for an 20 original or renewal CDL, and $6 of the total CDL instruction 21 permit fee when such permit is issued to any person holding a 22 valid Illinois driver's license, shall be paid into the 23 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License 24 Information System/American Association of Motor Vehicle 25 Administrators network Trust Fund) and shall be used for the 26 purposes provided in Section 6z-23 of the State Finance Act. 27 (g) All remaining moneys received by the Secretary of 28 State as registration fees or taxes or as payment of any 29 other fee, as provided in this Act, except fees received by 30 the Secretary under paragraph (7) of subsection (b) of 31 Section 5-101 and Section 5-109 of this Code, shall be 32 deposited in the Road Fund in the State Treasury. Moneys in 33 the Road Fund shall be used for the purposes provided in 34 Section 8.3 of the State Finance Act. -3- LRB9102399KSgcA 1 (h) (Blank). 2 (i) (Blank). 3 (j) (Blank). 4 (k) There is created in the State Treasury a special 5 fund to be known as the Secretary of State Special License 6 Plate Fund. Money deposited into the Fund shall, subject to 7 appropriation, be used by the Office of the Secretary of 8 State (i) to help defray plate manufacturing and plate 9 processing costs for the issuance and, when applicable, 10 renewal of any new or existing special registration plates 11 authorized under this Code and (ii) for grants made by the 12 Secretary of State to benefit Illinois Veterans Home 13 libraries. 14 On or before October 1, 1995, the Secretary of State 15 shall direct the State Comptroller and State Treasurer to 16 transfer any unexpended balance in the Special Environmental 17 License Plate Fund, the Special Korean War Veteran License 18 Plate Fund, and the Retired Congressional License Plate Fund 19 to the Secretary of State Special License Plate Fund. 20 (l) The Motor Vehicle Review Board Fund is created as a 21 special fund in the State Treasury. Moneys deposited into 22 the Fund under paragraph (7) of subsection (b) of Section 23 5-101 and Section 5-109 shall, subject to appropriation, be 24 used by the Office of the Secretary of State to administer 25 the Motor Vehicle Review Board, including without limitation 26 payment of compensation and all necessary expenses incurred 27 in administering the Motor Vehicle Review Board under the 28 Motor Vehicle Franchise Act. 29 (m) Effective July 1, 1996, there is created in the 30 State Treasury a special fund to be known as the Family 31 Responsibility Fund. Moneys deposited into the Fund shall, 32 subject to appropriation, be used by the Office of the 33 Secretary of State for the purpose of enforcing the Family 34 Financial Responsibility Law. -4- LRB9102399KSgcA 1 (n) The Illinois Fire Fighters' Memorial Fund is created 2 as a special fund in the State Treasury. Moneys deposited 3 into the Fund shall, subject to appropriation, be used by the 4 Office of the State Fire Marshal for construction of the 5 Illinois Fire Fighters' Memorial to be located at the State 6 Capitol grounds in Springfield, Illinois. Upon the 7 completion of the Memorial, the Office of the State Fire 8 Marshal shall certify to the State Treasurer that 9 construction of the Memorial has been completed. 10 (o) Of the money collected for each certificate of title 11 for all-terrain vehicles and off-highway motorcycles, $17 12 shall be deposited into the Off-Highway Vehicle Trails Fund. 13 (p) Of the moneys collected for late vehicle 14 registration renewal fees pursuant to Section 3-806.5, $16 of 15 each late renewal penalty shall be deposited into the Road 16 Fund, $16 of each late renewal penalty shall be deposited 17 into the Literacy Advancement Fund, and $16 of each late 18 renewal penalty shall be deposited into the Library Trust 19 Fund. 20 (Source: P.A. 89-92, eff. 7-1-96; 89-145, eff. 7-14-95; 21 89-282, eff. 8-10-95; 89-612, eff. 8-9-96; 89-626, eff. 22 8-9-96; 89-639, eff. 1-1-97; 90-14, eff. 7-1-97; 90-287, eff. 23 1-1-98; 90-622, eff. 1-1-99.) 24 (625 ILCS 5/3-806.5 new) 25 Sec. 3-806.5. Late renewal of registration; fee. Every 26 owner of a motor vehicle of the first division or a motor 27 vehicle of the second division weighing 8,000 pounds or less 28 who fails to renew the vehicle's registration prior to its 29 expiration shall be charged an additional $48 for late 30 registration of the vehicle. The additional moneys collected 31 from this $48 late renewal penalty shall be distributed 32 pursuant to subsection (p) of Section 2-119 of this Code.
