91_HB1674 LRB9103251EGfg 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 adding Sections 103-10 and 115-10.4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by adding Sections 103-10 and 115-10.4 as follows: 7 (725 ILCS 5/103-10 new) 8 Sec. 103-10. Recording of interrogation of person under 9 age 17. Beginning January 1, 2000, a law enforcement officer 10 or other person conducting a custodial interrogation of a 11 person under 17 years of age shall cause an audio and visual 12 electronic recording of the interrogation to be made. The 13 recording shall be preserved and made available to interested 14 parties in the same manner as physical evidence, until the 15 matter with respect to which the interrogation was conducted 16 has been finally resolved. 17 (725 ILCS 5/115-10.4 new) 18 Sec. 115-10.4. Admissibility of statements of person 19 under age 17. An oral or sign language statement made on or 20 after January 1, 2000 by a person under 17 years of age 21 during a custodial interrogation shall not be admissible at 22 trial unless an audio and visual electronic recording of the 23 statement was made and is available to the court. 24 Section 99. Effective date. This Act takes effect 25 January 1, 2000.
