91_HB1512 LRB9103626RCks 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 24-3.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 24-3.5 as follows: 7 (720 ILCS 5/24-3.5 new) 8 Sec. 24-3.5. Laser sight; prohibit sales and delivery. 9 (a) It is unlawful to sell or deliver a laser sight. 10 (b) Sentence. A person who violates this Section is 11 guilty of a Class A misdemeanor. A second violation of this 12 Section is a Class 4 felony. A third or subsequent violation 13 of this Section is a Class 3 felony. 14 (c) Exemptions. This Section does not prohibit the sale 15 or delivery of a laser sight to: 16 (1) Peace officers; 17 (2) Wardens, superintendents and keepers of 18 prisons, penitentiaries, jails and other institutions for 19 the detention of persons accused or convicted of an 20 offense, for use while in the performance of their 21 official duty, or while commuting between their homes and 22 places of employment; or 23 (3) Members of the Armed Services or Reserve Forces 24 of the United States or the Illinois National Guard or 25 the Reserve Officers Training Corps, for use while in the 26 performance of their official duty. 27 (d) Definition. "Laser sight" means a device that can 28 be attached to a firearm that emits light amplified by the 29 stimulated emission of radiation that is visible to the human 30 eye and that when attached to a firearm can be used to aid 31 the user of the firearm in identifying a target and in -2- LRB9103626RCks 1 improving the accuracy of the projectile in striking the 2 target when discharged from the firearm.
