1 AN ACT to amend the School Code by adding Section
2 2-3.126.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by adding Section
6 2-3.126 as follows:
7 (105 ILCS 5/2-3.126 new)
8 Sec. 2-3.126. County-wide unit school districts. The
9 State Board of Education, acting in conjunction and
10 cooperation with all school boards and school districts in
11 the State, shall develop, administer, and implement a program
12 under which, by July 1, 2004, all school districts in
13 Illinois are county-wide unit school districts, whose
14 territory shall be determined by county boundaries, and there
15 are no elementary or high school districts, those former
16 elementary or high school districts all being formed into or
17 annexed to a county-wide unit school district. In order to
18 achieve the purposes and objectives of this Section, the
19 State Board of Education is authorized to waive any
20 provisions of this Code otherwise applicable to the
21 annexation of territory to a unit school district or the
22 formation of a new unit school district and, with the
23 agreement of the school boards of all school districts whose
24 territory or any portion thereof is to be annexed to a unit
25 school district or included in the territory of a newly
26 formed unit school district, to declare the annexation to a
27 unit district or the formation of a new unit district
28 effective for all purposes by operation of law, subject only
29 to the election of the members of the school board of a newly
30 formed unit school district in accordance with law.

1 Section 99. Effective date. This Act takes effect July
2 1, 1999.
