1 AN ACT to amend the Illinois Public Aid Code by changing
2 Section 10-10.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 changing Section 10-10.1 as follows:
7 (305 ILCS 5/10-10.1) (from Ch. 23, par. 10-10.1)
8 Sec. 10-10.1. Public Aid Collection Fee. In all cases
9 instituted by the Illinois Department on behalf of a child or
10 spouse, other than one receiving a grant of financial aid
11 under Article IV, on whose behalf an application has been
12 made and approved for support services as provided by Section
13 10-1, the court shall impose a collection fee on the
14 individual who owes a child or spouse support obligation in
15 an amount equal to 10% of the amount so owed as long as such
16 collection is required by federal law, which fee shall be in
17 addition to the support obligation. The imposition of the
18 such fee shall be in accordance with provisions of Title IV,
19 Part D, of the Social Security Act and regulations duly
20 promulgated thereunder. The fee shall be payable to the
21 clerk of the circuit court for transmittal to the Illinois
22 Department and shall continue until support services are
23 terminated by the Department.
