91_HB1409enr HB1409 Enrolled LRB9101709JSpc 1 AN ACT to amend the Public Utilities Act by changing 2 Section 4-101 and adding Section 9-220.2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 4-101 and adding Section 9-220.2 as follows: 7 (220 ILCS 5/4-101) (from Ch. 111 2/3, par. 4-101) 8 Sec. 4-101. The Commerce Commission shall have general 9 supervision of all public utilities, except as otherwise 10 provided in this Act, shall inquire into the management of 11 the business thereof and shall keep itself informed as to the 12 manner and method in which the business is conducted. It 13 shall examine those public utilities and keep informed as to 14 their general condition, their franchises, capitalization, 15 rates and other charges, and the manner in which their 16 plants, equipment and other property owned, leased, 17 controlled or operated are managed, conducted and operated, 18 not only with respect to the adequacy, security and 19 accommodation afforded by their service but also with respect 20 to their compliance with this Act and any other law, with the 21 orders of the Commission and with the charter and franchise 22 requirements. 23 Whenever the Commission is authorized or required by law 24 to consider some aspect of criminal history record 25 information for the purpose of carrying out its statutory 26 powers and responsibilities, then, upon request and payment 27 of fees in conformance with the requirements of subsection 22 28 of Section 55a of "The Civil Administrative Code of 29 Illinois", the Department of State Police is authorized to 30 furnish, pursuant to positive identification, such 31 information contained in State files as is necessary to HB1409 Enrolled -2- LRB9101709JSpc 1 fulfill the request. 2 (Source: P.A. 86-610.) 3 (220 ILCS 5/9-220.2 new) 4 Sec. 9-220.2. Water and sewer surcharges authorized. 5 (a) The Commission may authorize a water or sewer 6 utility to file a surcharge which adjusts rates and charges 7 to provide for recovery of (i) the cost of purchased water, 8 (ii) the cost of purchased sewage treatment service, (iii) 9 other costs which fluctuate for reasons beyond the utility's 10 control or are difficult to predict, or (iv) costs associated 11 with an investment in qualifying infrastructure plant, 12 independent of any other matters related to the utility's 13 revenue requirement. A surcharge approved under this Section 14 can operate on an historical or a prospective basis. 15 (b) For purposes of this Section, "costs associated with 16 an investment in qualifying infrastructure plant" include a 17 return on the investment in and depreciation expense related 18 to plant items or facilities (including, but not limited to, 19 replacement mains, meters, services, and hydrants) which (i) 20 are not reflected in the rate base used to establish the 21 utility's base rates and (ii) are non-revenue producing. For 22 purposes of this Section, a "non-revenue producing facility" 23 is one that is not constructed or installed for the purpose 24 of serving a new customer. 25 (c) On a periodic basis, the Commission shall initiate 26 hearings to reconcile amounts collected under each surcharge 27 authorized pursuant to this Section with the actual prudently 28 incurred costs recoverable for each annual period during 29 which the surcharge was in effect.
