1 AN ACT to amend the Health Maintenance Organization Act
2 by changing Section 5-1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Health Maintenance Organization Act is
6 amended by changing Section 5-1 as follows:
7 (215 ILCS 125/5-1) (from Ch. 111 1/2, par. 1409A)
8 Sec. 5-1. Application of Section 155 of Illinois
9 Insurance Code. Section 155 of the Insurance Code shall
10 apply to Health Maintenance Organizations; except that no
11 action shall be brought for an unreasonable delay in the
12 settling of a claim if the delay is caused by the failure of
13 the enrollee to execute a lien as requested by the health
14 care plan.
