91_HB1255 LRB9101891EGfg 1 AN ACT to amend the Illinois Pension Code by changing 2 Section 15-146. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Section 15-146 as follows: 7 (40 ILCS 5/15-146) (from Ch. 108 1/2, par. 15-146) 8 Sec. 15-146. Survivors insurance benefits - Minimum 9 amounts. 10 (a) The minimum total survivors annuity payable on 11 account of the death of a participant shall be 60% (50% if 12 the death occurred before the effective date of this 13 amendatory Act of the 91st General Assembly) of the 14 retirement annuity which would have been provided under Rule 15 1, Rule 2, or Rule 3 of Section 15-136 upon the participant's 16 attainment of the minimum age at which the penalty for early 17 retirement would not be applicable or the date of the 18 participant's death, whichever is later, on the basis of 19 credits earned prior to the time of death. 20 (b) The minimum total survivors annuity payable on 21 account of the death of an annuitant shall be 60% (50% if the 22 death occurred before the effective date of this amendatory 23 Act of the 91st General Assembly) of either the retirement 24 annuity which is payable under Section 15-136 at the time of 25 death or50% ofthe disability retirement annuity payable 26 under Section 15-153.2, whichever is applicable. 27 (b-5) This minimum survivors annuity shall apply to each 28 participant and annuitant who dies after September 16, 1979, 29 whether or not his or her employee status terminates before 30 or after that date. -2- LRB9101891EGfg 1 The changes to this Section made by this amendatory Act 2 of the 91st General Assembly apply without regard to whether 3 the deceased participant or annuitant was in service on or 4 after the effective date of this amendatory Act. 5 (c) If an annuitant has elected a reversionary annuity, 6 the retirement annuity referred to in this Section is that 7 which would have been payable had such election not been 8 filed. 9 (Source: P.A. 90-448, eff. 8-16-97; 90-766, eff. 8-14-98.) 10 Section 99. Effective date. This Act takes effect upon 11 becoming law.
