91_HB1217eng HB1217 Engrossed LRB9103281RCks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 26-4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 26-4 as follows: 7 (720 ILCS 5/26-4) (from Ch. 38, par. 26-4) 8 Sec. 26-4. Unauthorized videotaping. 9 (a) It is unlawful for any person to videotape, 10 photograph, or film another person without that person's 11 consent in a restroom, tanning bed, or tanning salon. 12 (a-5) It is unlawful for any person to knowingly 13 videotape, photograph, or film another person in that other 14 person's residence, whether owned or rented, with a concealed 15 or hidden camera or other video recording device without that 16 other person's consent. 17 (b) Exemptions. The following activities shall be 18 exempt from the provisions of this Section: 19 (1) Videotaping, photographing, and filming by law 20 enforcement officers pursuant to a criminal 21 investigation, which is otherwise lawful; 22 (2) Videotaping, photographing, and filming by 23 correctional officials for security reasons or for 24 investigation of alleged misconduct involving a person 25 committed to the Department of Corrections. 26 (c) The provisions of this Section do not apply to any 27 sound recording of an oral conversation made as the result of 28 the videotaping or filming, and to which Article 14 of this 29 Code applies. 30 (d) Sentence.
