91_HB1136 LRB9101351NTsb 1 AN ACT to amend the Higher Education Student Assistance 2 Act by changing Section 36. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Higher Education Student Assistance Act 6 is amended by changing Section 36 as follows: 7 (110 ILCS 947/36) 8 Sec. 36. Illinois Incentive for Access grant program. 9 (a) The Commission each year shall determine eligibility 10 for the Illinois Incentive for Access grant from applications 11 received for Monetary Award Program grant assistance under 12 Section 35 of this Act. An applicant shall be determined as 13 eligible for an Illinois Incentive for Access grant under 14 this Section when the Commission finds that the applicant: 15 (1) is a resident of this State and a citizen or 16 permanent resident of the United States; 17 (2) has no personal or family financial resources 18 available for expenditure on educational expenses, as 19 defined by current federal student financial aid 20 methodology; 21 (3) has not already received a baccalaureate 22 degree; and 23 (4) is enrolled at least one-half time as a 24 freshman or sophomore undergraduate student at an 25 approved Illinois institution of higher learning 26 participating in the Monetary Award Program administered 27 by the Commission. 28 (b) Subject to a separate appropriation made for 29 purposes of awarding grants under this Section, Illinois 30 Incentive for Access grants shall be paid in multiple 31 disbursements as determined by the Commission in an amount -2- LRB9101351NTsb 1 not to exceed $500 per applicant per year. No recipient may 2 receive a grant under this Section for more than 423 semesters or 63quarters of award payments. 4 (c) Eligibility for grants awarded under this Section 5 shall be determined solely on the basis of the financial 6 resources of the applicant and the applicant's family. Cost 7 of attendance at the institution in which the applicant is 8 enrolled shall not affect eligibility for an award, except 9 that State student financial assistance awarded under this 10 Act, including the Illinois Incentive for Access award, may 11 not exceed the institution's cost of attendance. 12 (d) The Commission shall notify applicants that grant 13 assistance is contingent upon availability of appropriated 14 funds. 15 (e) The Commission shall submit a written evaluation of 16 the Illinois Incentive for Access program to the Governor, 17 the General Assembly, and the Board of Higher Education on or 18 before October 1, 1999, including a report of the progress 19 made toward the goal of increasing the access and retention 20 rates for Illinois Incentive for Access grant recipients. 21 (Source: P.A. 89-512, eff. 7-11-96.) 22 Section 99.
