Amend House Bill 999 on page 1, by 3 replacing lines 1 and 2 with the following: 4 "AN ACT relating to education."; and 5 on page 1, by replacing lines 5 and 6 with the following: 6 "Section 1. Short title. This Act may be cited as the 7 Fund Education First Act. 8 Section 5. Educational appropriations. Beginning with 9 fiscal year 2000 and in each fiscal year thereafter, subject 10 to the provisions of Section 10 of this Act, the General 11 Assembly shall appropriate for educational programs an amount 12 that is equal to or exceeds the sum of: (a) the total amount 13 appropriated from general funds for educational programs 14 during the fiscal year immediately preceding the fiscal year 15 for which the appropriation is being made; and (b) 51% of 16 total new general funds available for spending from estimated 17 growth in revenues and funds available because of budgeted 18 program growth and decline in the fiscal year for which the 19 appropriation is being made, excluding annual State 20 contributions to the Teachers' Retirement System of the State 21 of Illinois, the Public School Teachers' Pension and -2- LRB9103753PTpkam03 1 Retirement Fund of Chicago, and the State Universities 2 Retirement System. 3 Section 10. State and federal funding. State funding 4 for educational programs shall continue to be appropriated 5 pursuant to the formula established in Section 5 until the 6 sum of State and federal spending represents one-half of the 7 total revenues available from local, State, and federal 8 sources for elementary and secondary education programs for 9 the current fiscal year, as estimated by the State 10 Superintendent of Education. 11 Section 15. Allocation. Two-thirds of the new general 12 funds to be appropriated pursuant to clause (b) of Section 5 13 shall be appropriated for elementary and secondary 14 educational programs and one-third shall be appropriated for 15 higher education programs. 16 Section 20. Governor's budget. Beginning with fiscal 17 year 2001 and in each fiscal year thereafter, the Governor 18 shall include in his annual budget an allocation for 19 elementary and secondary education and higher education which 20 conforms to the provisions of this Act. 21 Section 105. The Illinois Income Tax Act is amended by 22 changing Section 201 as follows:"; and 23 on page 20, below line 26, by inserting the following: 24 "Section 999. Effective date. This Act takes effect 25 upon becoming law.".
