91_HB0828 LRB9104883RCsb 1 AN ACT to amend the Unified Code of Corrections by 2 changing Section 3-7-2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unified Code of Corrections is amended by 6 changing Section 3-7-2 as follows: 7 (730 ILCS 5/3-7-2) (from Ch. 38, par. 1003-7-2) 8 Sec. 3-7-2. Facilities. 9 (a) All institutions and facilities of the Department 10 shall provide every committed person with access to toilet 11 facilities, barber facilities, bathing facilities at least 12 once each week, a library of legal materials and published 13 materials including newspapers and magazines approved by the 14 Director. A committed person may not receive any materials 15 that the Director deems pornographic. 16 (b) (Blank). 17 (c) All institutions and facilities of the Department 18 shall provide facilities for every committed person to leave 19 his cell for at least one hour each day unless the chief 20 administrative officer determines that it would be harmful or 21 dangerous to the security or safety of the institution or 22 facility. 23 (d) All institutions and facilities of the Department 24 shall provide every committed person with a wholesome and 25 nutritional diet at regularly scheduled hours, drinking 26 water, clothing adequate for the season, bedding, soap and 27 towels and medical and dental care. 28 (e) All institutions and facilities of the Department 29 shall permit every committed person to send and receive an 30 unlimited number of uncensored letters, provided, however, 31 that the Director may order that mail be inspected and read -2- LRB9104883RCsb 1 for reasons of the security, safety or morale of the 2 institution or facility. 3 (f) All of the institutions and facilities of the 4 Department shall permit every committed person to receive 5 visitors, except in case of abuse of the visiting privilege 6 or when the chief administrative officer determines that such 7 visiting would be harmful or dangerous to the security, 8 safety or morale of the institution or facility. The chief 9 administrative officer shall have the right to restrict 10 visitation to non-contact visits for reasons of safety, 11 security, and order, including, but not limited to, 12 restricting contact visits for committed persons engaged in 13 gang activity. Beginning January 1, 2000, a committed person 14 may not be permitted contact visits if he or she is 15 classified as a Class C grade inmate as defined by the 16 Department or if he or she is housed in a segregated part of 17 the facility for disciplinary reasons. A committed person 18 may not be permitted contact visits for one year after being 19 found in possession of illegal drugs or failing or refusing a 20 test for the presence of illegal drugs in his or her body 21 while incarcerated. 22 (g) All institutions and facilities of the Department 23 shall permit religious ministrations and sacraments to be 24 available to every committed person, but attendance at 25 religious services shall not be required. 26 (h) Within 90 days after December 31, 1996, the 27 Department shall prohibit the use of curtains, 28 cell-coverings, or any other matter or object that obstructs 29 or otherwise impairs the line of vision into a committed 30 person's cell. 31 (Source: P.A. 89-609, eff. 1-1-97; 89-659, eff. 1-1-97; 32 89-688, eff. 6-1-97; 89-689, eff. 12-31-96; 90-14, eff. 33 7-1-97.)
