Amend House Bill 731 by replacing 3 lines 23 through 29 on page 1 and lines 1 through 21 on page 4 2 with the following: 5 "Section 10. The Sex Offender and Child Murderer 6 Community Notification Law is amended by changing Section 115 7 as follows: 8 (730 ILCS 152/115) 9 Sec. 115. Sex offender database. 10 (a) The Department of State Police shall establish and 11 maintain a Statewide Sex Offender Database for the purpose of 12 identifying sex offenders and making that information 13 available to the persons specified in Sections 120 and 125 of 14 this Law. The Database shall be created from the Law 15 Enforcement Agencies Data System (LEADS) established under 16 Section 6 of the Intergovernmental Missing Child Recovery Act 17 of 1984. The Department of State Police shall examine its 18 LEADS database for persons registered as sex offenders under 19 the Sex Offender Registration Act and shall identify those 20 who are sex offenders and shall add all the information, 21 including photographs if available, on those sex offenders to 22 the Statewide Sex Offender Database. -2- SRS91HB0731JJcham01 1 (b) The Department of State Police must make the 2 information contained in the Statewide Sex Offender Database 3 accessible on the Internet by means of a hyperlink labeled 4 "Sex Offender Information" on the Department's World Wide Web 5 home page. The Department of State Police must update that 6 information as it deems necessary. 7 The Department of State Police may require that a person 8 who seeks access to the sex offender information submit 9 biographical information about himself or herself before 10 permitting access to the sex offender information. The 11 Department of State Police may limit access to the sex 12 offender information to information about sex offenders who 13 reside within a specified geographic area in proximity to the 14 address of the person seeking that information. The 15 Department of State Police must promulgate rules in 16 accordance with the Illinois Administrative Procedure Act to 17 implement this subsection (b) and those rules must include 18 procedures to ensure that the information in the database is 19 accurate. 20 (Source: P.A. 89-428, eff. 6-1-96; 89-462, eff. 6-1-96; 21 90-193, eff. 7-24-97.); and 22 on page 4, line 24, after "offenders", by inserting "where 23 any victim was 13 years of age or younger and"; and 24 on page 4, after line 33, by inserting the following: 25 "Section 99. Effective date. This Act takes effect on 26 July 1, 2000.".
