91_HB0722 LRB9103250RCpr 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 adding Article 106E. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by adding Article 106E as follows: 7 (725 ILCS 5/Art. 106E heading new) 8 ARTICLE 106E. VIDEOTAPE OF CONFESSIONS 9 (725 ILCS 5/106E-5 new) 10 Sec. 106E-5. Videotape of confessions of suspects. 11 (a) A peace officer who interrogates a person suspected 12 of committing an offense and obtains a confession from the 13 suspect must inform the suspect that before the confession is 14 admissible in court, the confession must be videotaped. 15 (b) The videotape is admissible in court in a 16 prosecution of the suspect for an offense if the suspect 17 confesses to the offense or otherwise makes an admission that 18 may be used in a prosecution of the suspect for the offense 19 and if the suspect recants his or her confession or 20 contradicts any admission made to a peace officer. 21 (c) The failure of a police officer to videotape the 22 confession of a person suspected of an offense renders the 23 confession inadmissible in any trial of the suspect for the 24 offense for which the suspect has confessed.
